BENNETT PROPERTY MANAGEMENT MISREPRENTED A HOUSE FOR RENT AND KEPT THE FEES ON A HOUSE THAT WAS ALREADY RENTED MESA Arizona

Few days ago we met with an agent (KIM from now on known as "she" or "agent") from Bennett Property Management.

she showd us a home for rent that we loved. It is a new house which was NEVER lived in. When asked when was the LAST TIME the house was walked into she replied september 2008, And in her own words said the house is available right now and no one is interested in it since september 2008 and never been rented since it was built.

We signed all papers to evaluate our credit history and paid the fees for the papers. We also wanted to place a $500 down payment to hold the house, and she said the house is available and NO ONE has been interested in it, so the house is ours pending our application approval. The down-payment we offered to secure the house was not needed or wanted.

We got a call by the agent a day later to say we are approved and all is a go.I started packing and we had many plans, including placing money down for a moving company (since i can't lift for medical condition). THREE DAYS AFTER we looked at the house the agnet called my fiance and plainly said you are approved, but sorry the house is already taken by a man who got approved a day earlier.

SHE LIED to us by presenting the house as available! And she also used her own words to say the house has been available all this time and the ONLY time its been walked thru was september 2008.

THE ONLY REASON we paid for the app. fees is because WE WERE TOLD the house is ours if we get approved. KIM refused to refund the application fees, and dodged the issue by trying to sell her services AGAIN by finding us another new house.

KIM FLAT OUT REFUSED TO RETURN OUR FEES WITH AN ARGUMENT OVER THE PHONE So as you can see, we took all proper steps to 1: AFFIRM the house will be ours if our application is approved, and 2: by asking several times wbout the availability of the house, and 3: by asking for a refund on the dishonest represented house application fees.
