I received an offer from Capital One for a personal loan several years ago; these offers came in the mail (unsecured personal loans) and was by invitation only.  After the economy and housing market went bust, Capital One started to do "account reviews." 


Capital One noticed that I had fallen behind on some bills and then I noticed my personal loan was appearing on my husband's credit report.  I contacted Capital One and told them about this and they told me he was a co-signer.  So, I challenged them and asked for a signed contract - which they could not and would not produce.  However, I had a copy of the cancelled loan check with only my name and signature on it. 


I contacted the BBB, OTC and FTC and filed complaints against Capital One.  Capital One insists they did nothing wrong.   What happened here is Capital One got nervous about not being paid and they tacked my husband on but what they don't understand is that this is an unsecured loan and if we went to court, no judge is just going to take Capital One's word for it that my husband is a co-signer with a signed loan application. 


It is unreal what some creditors will do and get away with.

I am gratified to see that someone will possibly make a HUGE profit on the nasty business practices that is plaguing our country and our neighbors in the world. It is only recently that the American people have encountered what our international neighbors know about our banking system. Deregulation is the problem and there needs to be pressure against the corporations and banks to get anything done. They simply REFUSE to regulate themselves. And we the poor folk naively thought they would do so - "there is no honor among thieves" as a good quote for this evil and amoral practice.

Capital One will not provide copy of Contract.

I have read the posts & I am not too worried about it...it's mostly for informational purposes, for others & the like.  Capital One will not provide a copy of the signed contract/application.  Capital One continously dodge the request & send copies of statements which is hilarious.  I am almost done with law school so I think I will make Capital One my pet project.  I have been doing paralegal work for many, many years & my next logical step was to become an attorney.  I am well aware how these banks manipulate the system, lie & cheat.

I am sorry if you think a question on how Capital One would know about the husband if they weren't on the account was "defending" the bank.

But seriously since they did respond.  Yes the default feeling of some is that the banks are evil and will do anything they can to get their money.  Some people would go as far as thinking that bank employees are personally targeting them for one reason or another.  The OP really wants to believe that Capital One is so concerned about loosing money on that account, that they gave her "personal" attention.  In that Capital One is willing to possibly commit a crime in obtaining the Husbands(and how would they know 100% that he was the husband) information.  Then on top of that INTENTIONALLY posting invalid information on the husbands credit reports.  Which at the very least is a violation of the Fair Credit Reporting Act where they could be sued.  All because they "think" that the OP will become delinquent.  Then even if they "stick" the husband with the account and the wife is delinquent wouldn't that pretty much reduce the possibility that the husband would pay either.

Yes, let the conspiracy theories fly.

Really..banks are not that concerned if you are delinquent.  Not that they don't want their money..because they do.  But if you don't pay they will just sell your account(at a discount) to a Collection Agency.  To them that is a much more effective way to cut their losses than the "lets put the account on the spouse who may not pay us either", because at least they get something.

Not knowing the exact details it is hard to say if the Husband was not a co-signer and the OP may be trying to use some technicallity(right or wrong) to keep the husband from being responsible.  But if the loan was to the OP's name ONLY, and there was not a single reference to her husband on the terms or the check then yes the OP is most likely right it should not be on the husbands report.  And if they refuse to remove it then he(since it is on his report) may want to look into going after them for violations of the Fair Credit Reporting Act.  But one caviat to that is that if this was a Community Property State situation that may change things, although New Jersey is not one.

How did they know about my husband?

You ask how did they know about my husband?  When a couple is married as long as we have been, our mortgage is a joint venture and so are other items such as cars or whatever have you.  Capital One does a credit review and I don't have to tell you how easy it is for them to get your spouse's information.  Today, anyone can purchase your personal information on the web for a mere $39.  There are so many ways to find out who your relatives are especially spouses.  In addition, my husband has his own Capital One credit card.  This isn't the first time a creditor has done something like this...Household has, Beneficial has...the real question is why won't Capital One just give us a copy of the signed agreement.  In the court of law, the judge would need to see such document in order to side with Capital One, for instance in a bankruptcy proceeding.  Hope this answers your question.
