Car Hop UAC My son Kevin needed to purchase a vehicle to get to and from work and decided to go to Carhop to purchase a car because of the low down payment. I went with him to support him in getting his own car he was told he needed a co-signer and since I was their I decided to be the co-signer for hi but instead of me being the co-signer so how I became the primary person on a vehicle that I did not need. Vallejo California

Car Hop UAC My son Kevin needed to purchase a vehicle to get to and from work and decided to go to Carhop to purchase a car because of the low down payment. I went with him to support him in getting his own car he was told he needed a co-signer and since I was their I decided to be the co-signer for hi but instead of me being the co-signer so how I became the primary person on a vehicle that I did not need. Kevin made two payments on the car and the engine blew up. We first took the car to a private automotive shop that did a estimate of repairs who stated that car should have never been sold it was a lemon. We the contacted Car Hop and was told to take the car to their shop because the car was under warranty. We received a call from the car repair stating they would pay for the engine but the oil had cause damages to other parts of the car in which Car Hop would not cover under warranty and that we would have to pay $1,500 dollars. We contacted Car Hop spoke with several people and the only thing they were concern about was that we continued to make a payment on a car that was not working. Car hop representative was told to go and get the car back and that we no longer wanted to pay for a car that we believed to be a lemon. Car Hop uses a finance company called UAC who has since then repossessed the Car and placed this repossession on my credit report for 8,000 dollars and charged the car off. To my surprise the car is still sitting at the repair shop but I am left owing the same amount that the Car originated without a car. Car Hop is such a rip off their associates will trick you into purchasing these vehicles with the low down payments especially younger people that dont know any better so they can repossses the cars and then charge them off. If that is not a rip off I dont know what is. Vallejo California

I am really curious as to what you think a "Co-Signer" is?

Because it is not just some random word that magically allows people to finance a car.  First of all notice the letters "Co", not primary/secondary but "co" as in equal.  So you have an exactly equal "stake" in this car as the other borrower does.  The concept of "primary" and "secondary" borrower really does not exist.

When you become a Co-Signer you are making a legal agreement that in the event that the other borrower does not make the payments(for whatever reason), YOU become legally responsible for the payments.   If the payments are NOT made then just like the borrower can be hit with negative credit, so can you.  This is why you will find many people advise against becoming a co-signer.

Now, just in case when you say you were the "primary" borrower, you mean you were the ONLY signer on the loan.  Well that is 100% on you then.  As before you signed the loan documents you should have inquried as to why your son was not on the loan.  And if you truly didn't want to have the loan to just walk away.

Onto the car.  You purchased the car "as-is", that means that the moment you signed the contract it was yours and anything that goes wrong with it is YOUR responsibility.  In your case you had a warranty, and unless they are violating the terms of the warranty and not covering something that should be covered, any repairs are your responsibility.

So yes, once you failed to make the payments the car is going to be "repossessed".  Eventually you will fine that they will sell the car at auction and what ever the difference is, you will be responsible for.  If you still fail to pay they can file a lawsuit against you.

Just one final point, a "lemon" is a term for a new car.  You bought a USED car, and I bet a very..very used car.  Where what you should have done(and do in the future) that before you purchase any car to take it to a mechanic to have them check it out and let you know the condition BEFORE you make your purchase.
