In early November, when PACT still had not been voted on, I ordered cigarettes from this company. I had ordered before, and had not had a problem. The problem started with THIS order. I used an on-line check, as before, and was told my order would ship the next day. I waited one week, and called. I was told that they didn't have enough of my brand on hand earlier in the week, and my order would ship the next day. I waited another week, and phoned again. This time I got a recorded message saying to check their website. The website had a notice that their warehouse had been seized by ATF ---but no explanation WHY that had happened--and that ATF needed to sort out which orders were still outstanding, and that I could expect a refund. Well, THAT never happened. I contacted ATF, and no one there would give me any information whatsoever. They would 'neither confirm nor deny' any seizure, etc.
Is there ANY way for us to get our money back? I've never been in this kind of position before. Any problem I have ever had with a retailer, I've been able to work out directly with the company. Class action suit? Internet fraud? Anything?

I have heard rumors that the ATF has already started contacting some of the customers of this company who received shipments in the past, and they are presenting them tax bills for the tobacco sales taxes that were unpaid
If I were you, I would not contact ATF to try to get a refund, especially if you have ordered cigs from this company, and have received them. You might get a big fat tax bill for your trouble!!!

Does anyone have any idea if our personel info is going to be compromised? In other words, are we going to be hit with tax bills?

It's not about sales tax-it's about the EXCISE TAX that NY puts on each pack of cigarettes.
Further, some time ago NY enacted legislation (forget the federal law) so that it IS CRIMINAL to avoid paying the excise tax, unless you are a native american (and can prove it.)
In fact, if you check the NYS laws, if you are NOT a native american it is an offense to be IN POSSESSION of any cigarettes that DO NOT have the NYS EXCISE TAX STAMP on them (unless there is an excise tax stamp from another state.)

attempting to avoid sales tax? you bet! and nothing illegal about it. goods are sold across state lines every day, and unless the retailer has a business address within the state to which the goods are shipped, sales tax is NOT due. -- and purchasing five cartons of cigarettes once a month would NOT be a profitable RESALE business.

You were buying tobacco products over the internet trying to curcumvent paying your State and Local taxes.. You were in fact committing a Felony by trying to get away without paying your taxes on tobacco.. Consider it a cheap lesson. BATF puts people in Prison for that. BATF has an ongoing investigation concerning Internet sales of Tobacco products that cross state lines. Most of these companies buy them Duty Free or from Indian Reservations, and resale them to the public. Also Illegal.
