I called a debt collector that was trying to contact me by leaving a name and number with my mother's answering machine on several occasions. He never mentioned that a debt was owed, just wanted her to contact me. I finally called him. He was pressuring me into making a phone check payment during the call. He also wanted me to make payment arrangements then.
He asked what I would consider to be a fair payment amount, and I said $65 a month just like I had been paying regularly on the Circuit City credit card. He said that was "unacceptable" and I HAD to agree to a one time lump sum of just over $800 or 3 monthly payments of equal amount. He also said that a judgement had already been filed against me. If I had a judgement entered against me, I would have recieved papers from the county I live in. He also said if I didn't want to pay now, to hire a lawyer because I would lose in court and also have to pay court costs and other fees.
After finally getting him to back off on the phone payment, I told him I would see what I could arrange. He said to call him before 4pm on Thurs. or before noon on Friday or else he would take further action. Is this acting within the laws of fair collection practices? I THINK NOT! If they are doing the same thing to you, let's get together and turn the tables on them!

Are you in missouri? I am familiar with the collections dept. at chase. They collect on the card issued by chase under the cicuit city name (like disney, toy r' us, etc) and to say that a "Judgement" will be issued against you sounds suspicious. First of all...if he made a legal "promise" (translation: threat) against you and any property then he should be able to follow through. Missouri is not a litigation state. Those states are: New Jersey, New York, and Illinois. There are two others however I cannot recall which two states they are. I CAN tell you that Missouri is NOT a litigation state. And since there is no prison for debtors ( at least not yet ) you have nothing to worry about. Collection laws pretty much state that a collections person cannot give legal advice and he would be in violation of company policy AND state and local laws. He is mis-representing himself for the sole purpose of misleading you and making a legal threat over the phone is NOT the thing to do. It's like me calling any one here and saying I'm an officer of the law and I'm going to come over and shoot you. I'm impersonating an officer of the law and making a threat. Double whammy. A person calling...saying they have legal recourse when they don't and promising to do this and whatever else they can dream up is illegal. Call the guy back. If he calls then tell him to go to hell and smoke a turd. Tell him calls to your mother WILL cease and desist. If he struggles then tell him you will write a letter and a 10 day hold on calls MUST be honored to allow time for your correspondence to arrive. In other words: NO CALL FOR 10 DAYS. THIS IS YOUR RIGHT AS A CONSUMER AND IS FINAL. Then CALL CHASE directly. Have them explain the balance of your account (you should have a statement, right?) while you read over your last statement. If you are being billed overlimit fees then try to pay more to get it under control. If you are so many days past due I would recommend making a larger payment over the next three (3) months if possible. Or at least try to round up the payments to an even 100.00. Tell this to chase and have THEM tell you if that's going to make a difference. Since you have'nt posted the balance due on the account or if it is past due I can't give you any more details. 65.00 per month may not be enough and a past due amount may still linger and is rolling over each month. If you are going thru a difficult time bringing it current speak with the collections area at chase and explain your hardship. If you are being consistent with your payments of 65.00 per month ASK what your real monthly payment is. Who knows, your average monthly payment may be in the neighborhood of 75-80.00 per month and you are not covering that thereby causing the account to go past due. The guy you mentioned is rated on the number of dollars collected and the months the account rolls back. Get someone else and air out your greivance with them. Have them explain what you are doing wrong. Ask if it's possible to "reage" your account to snap the account to a current status (you may have to pay a lump sum less then the amount due and this amount may be split over two months or three months but I don't recommend stretching it over three months because you will still get penalized any fees during the "Reage" process....EX: your amt due is 650.00 and reage is available for, say, 295.00 then that's a hell of a deal and if you have the money just pay it all then....after that's done your account is current and you can start your regular payments next month with a current account in good standing with the bank which will then be reported every 30 days as current which helps with your credit score) then continue paying 65.00 - 80.00 per month.

This is like beating a dead horse with people with this card. The credit card may say Circuit City on it, but Chase is who the card is from. So this is a false report against Circuit City. They have nothing to do with the collection on the card. So maybe you should file this complaint under Chase and not Circuit City. The bottom line here is CHASE is responsible in the end not Circuit City. To state the obvious, they wouldn't be collecting on you if you really paid your bill.
