I had a house in Michigan with my now ex-husband. It was back in payments before we got divorced. We got divorced and I move down to Texas. My ex got the divorce decree to be where he is to take care of the debts and that posession goes to whomever has posession at the time of divorce.
He lived at the house in Michigan so that means the house is his. I signed over the house to him but now Chase wants me to pay and is giving me bad credit. Chase told me to send a copy of the divorce decree and it would all be settled. I sent it over 4 times and I still have bad credit and still responsible for the house. All I want is to be off of the house and have good credit again.

Divorce doesn't do the trick....

Unfortunately, Robin...your divorce decree stating that your ex is responsible for the bills just doesn't cut it.
You have to have your names removed from the accounts (i.e. credit cards) and most of the time, especially with a Mortgage, a divorce decree isn't going to get your name off of the loan. Refinancing is the only true and safe way to get your name off the Mortgage and the Note. Which in turn would not effect you should he not pay the bills on time.
If someone in Customer Service tells you they are going to take your name off with only a divorce decree, ask for their first AND last name, Suoervisor's name and ask them to give you a "Release of Liability" to complete and should be accompanied with your divorce decree and a signed, notarized and fully executed Quit Claim Deed. And don't fax anything, it's way too easy to say "I'm sorry, I must not have gotten your fax" Send it certified mail where someine MUST sign for it!
