letter to Circuit city:
I just recently purchased a 50 inch Phillips TV from your store the date was 2-03-06 (ticket number 44290079***) which was a Friday. My wife and I rented a Uhaul and went to the store to pick the TV up that evening. After surfing the internet all day Saturday up until the wee hours of the morning Sunday at 1 am I went back to your site to find that the 60 inch Phillips was on sale for only 299.00 more( with a 100.oo rebate which made it really only 199. more).

The website at this time still
reflected that sale so I called the 1800 number and spoke with a representative who told me that the TV was not available for back order and the only store that I could pick it up at was 84 miles away, and he also had informed me that the rebate had expired after 11:59 that evening. I told him that the rebate did not matter because it would not make any since for me to pass a deal up like that and I would like to know how I can get the 60 for that price since it is still on the web.

He told me to wait until after 6 am Sunday when the add changes then go up to the store and see if you can get that price. Also he put me on an email notification to alert me for future sales.

Well I did as your representative advised me by waiting until the next morning and the TV went back to the original price 1799.99. I again called the 1800 number the next morning and spoke with a operator by the name of John Henry to see if some one could help me with this situation again and the best answer I could get was "you can take the TV back and the store can give you adjustment or not" I didn't quite understand that response but it seemed to hint at the fact that it is
the stores discretion to allow for price adjustments so I decided to call the store manager where I purchased the TV, and also ask for the corporate number but Mr. Henry told me that since it was Sunday I could not speak to corporate so I just took down the address.

I called the store manager at location 3200 around noon that Sunday and spoke with an associate and explained the situation to him and he told me that there were three 60 inch TVs on back order. Then I told him I was informed by the 1800 number that you guys are not allowed to back order, because if that were so I would have been able to get a 60 inch from this location for $1,299 versus paying $999 for a 50 inch as I had done. I asked them since they have some on back order can I get one and get a price adjustment for the sale that was just yesterday.

He put me on hold and told me he was going to talk to a manager because that was out of his hands. When he came back to the phone he told me the manager said that the reason he couldn't do the adjustment was because of the
"rebate thing". I asked him could I return the one we have and could some one pick it up and he told me that I would have to come to the store to arrange that and pay a delivery fee for pick up (which of course is reasonable).

Obviously unsatisfied, I called again spoke with the same store rep and asked to speak with the manager myself. The manager was unavailable so Ileft a number for him to call me back.

I did try back again around 2 30 pm and spoke with a lady who was very nice and promised she would hand deliver my message to the manager to call me back.

I finally get a call around 4pm ish and spoke with Randy or maybe Ruben was his name I know it started with an R. I told him of the situation in whole and asked him could I get one of the TV's that were on back order or get one back ordered for the special price that was honored. He told me that he could not do that and that the TVs on back order were a mistake and those 3 customers probably wont receive theirs either. I also asked him for the corporate number and he told me to call again the1800 number which would put me right back where I started from.

Can anyone help me? I would still love to get the 60 inch for the Saturday the 4th sale price even without the rebate. I love Circuit cityand shop often but it seem like the 1800 the stores and the web with theexception of web only offers are not in sync and the left hand really doesn't know the right at all. I would love to have a happy ending to this story, thanks for hearing me out.

That was my first letter here was the response:

I never got a call so I wrote again after the second half of the experience:

Hello I am writting to you again in regards to the situation below. This will probaly be my last time dealing with circuit city again. I waited to see if the store was going to contact me about the television before I returned it which was not what I was wanting to do. Well after no call. I decided to give in.

Today I returned the television rented a uhaul again and loaded it onthe truck with the help of my neighboors to take it back to the store.
We used a dolly because the tv is pretty heavy. When I got to the store to return it the two guys who took the tv off the truck used no dolly and scrapped the bottom of the tv up. I told them as they were moving it that there was a lip at the tip of the truck and they would need to lift it. Well they did not thereby scrapping the base of the tv. As they were coming down I told them to lift it again because the wheels were not on the edge they again ignored me and scrapped the tv even more. I had left the remote so the tv could not be processed until i went home to retrieve it and returned.

When I got back to give the remote I dealt with sales rep jhon Ford who went and got the manager. The manager immediatly told me that he could not take the tv back because it was damaged, I told him about how they pulled it off the truck but he cut me off and told me that the guys said it was already like that on the truck. I tried to explain again and he cut me off and reffered to what they said taking the attitude that he was going to belive what they said no matter what. Then he said well we can take it back, but I must charge you 300 dollars for the damages (that his employees put there).
Frustrated I said ok because I did not want to cause a scene. My ticket number reflecting this horrible transaction is 32000336****.

What was weird was that when the sales rep john tried to put the funds back on my card the computer said something about having to send some of the money back by a check in the mail. The manager came over and did something to the computer and took the 300 dollars off and gave me the rest back on my card.

And so goes the end of my story with circuitcity when all I asked for was an adjustment or a reasonable explanation. I hope you all find a more friendlier and more hospitable manager before store 3200 goes down the tubes and I feel sorry for those people who wont get their tvs that are supposedly on "back order" as the 1800 number told me back order did
not exist. I guess it only exist for some and not for others. In the endall I can say is that although I tried to remain a loyal customer with you guys, I wind up out of 300.

and i received another cut and paste letter from the same rep:

I don't understand ...

AUTHOR: Peter - (U.S.A.)

All of this commotion over an item that is not even in stock?

Circuit City will not back-order something unless they are certain that they will be getting more in. There are times, of course, when the manufacturer does not send more of an item -- i.e., when they cannot produce enough to satisfy the demand (around the holidays perhaps?), when they are discontinuing a current model to make something newer, etc.

Circuit City may have claimed that other people had this TV on back-order, BUT do you know for a fact that these people ever got their TVs? They could have been sitting around for months, waiting for a TV that they never ended up getting.

At least the store was honest with you in that the TV was not in stock, and could not be back-ordered. Alternatively, they could have taken your money to place the TV on back-order, while you sit around waiting months on end for nothing. Why not be happy with the TV that you purchased and get on with your life?
