I bought a 42" Philips Plasma TV in late 2004 ($1799.99), and bought the "In Home" protection plan with it ($499.99). Six months later the tv started to black out so I called the advantage protection plan 800 number.
Circuit City told me to go down to my local store and exchange it which I did. I had to pay for a new protection plan in the amount of $499.99, and was reimbursed about $110 based upon the proration of the previous plan. The manager was very helpfull and allowed me to upgrade to a 42" Philips Plasma with Ambilight.
That was Feb. 2006, now this plasma broke. I called Circuit City protection plan 800 number and they sent a TV repair guy to pick the Tv on Sep. 7th 2007. The tv shop advised Circuit City that the panel was bad and I got a claim/exchange number on Oct. 16th due to "beyond economical repair".
I went dow to my local Circuit City the other day with the bad tv in hand as advised. Circuit City was directed to replace my tv with a Samsung HP-T4254 which I refused and this is what I explained to them.
I purchased the protection plan for a tv with the Ambilight feature and the plan states to replace an item with "an item with similar features". For example if I bought a Ford they could replace it with a Chevrolet but they would both have to have similar features like air conditioning, power windows. If I had a Chevrolet with OnStar well they would have to exchange with something that also had OnStar.
Circuit City's hands were tied because they didn't have any Philips Tv's with Ambilight at the store, out of stock and unavailable online so I went home with my bad tv.
I'm now waiting for a Circuit City corporate office case manager to come to a decision. My position is that I want a new flat panel tv with Ambilight which of coures would have to be a Philips. My other concern is that when you by a protection plan that states it is an "In Home" plan they should be hauling the tv's around, not me.
I'm very dissatisfied and feel that Circuit City is in breech of contract. I intend on taking them to court if I am not satisfied.I have paid $499.99 + $499.99 - $110.00 = $890.00 and I still have a bad tv after 2 months.
