I searched online and found this site after I had a
very unpleasant experience with West Los Angeles Circuit city Store last Sunday 1/4/2004. This goes back to Chrismas shopping.

On 12/23/2003, My wife and I were shopping on Circuit city. I bought a brand new 160G western digital hardisk then. I never used it and I didn't even open the box. And last Sunday, 1/4/2004, I felt I don't really need it thhough it is really cheap after rebate and so I took it back to the West Los Angeles store ,trying to return it.

The associate there wanted to open the box to check. I even told him that I didn't open the box, trying to save time, because I was planning to go to play basketball game with my friends. When he pulled away the plastic
sheeve outside the box, opened it and checked it, he told me to wait. After sometime, he came back with a manager.

The manager told me very unkindly that it was a floppy drive inside the box. And they cannot take it back. I told him that I didn't even open the box and the associate opened the box right there just a minute ago.

Well, he said it is easy to put the package and plastic sheeve back, looking at me as if I was a thief and I swapped the item. I felt I was so much humiliated and was
out of anger. After some argument with him, I only got a
claim tel number back. And the next day, which is Monday,
I got up around 9:30 and called the number and after 10 minutes' waiting and I filed a claim with a lady. She told me she will go to the store and look into it and get back to me 24-48 hours.

I gave her all my numbers,home #, cell # and office #. Until this morning,Wednesday, I didn't have any response. So I called again, this time, the other lady, after putting me on hold for some time, told me she is going to get back to in 24 hours. I was not happy with it and still agreed. Now I am waiting for their reply. I will update this report in the next few days.

Regarding the first point. The box was shrink-wrapped very well, just like all the other ones
in the shelf. you can say I am so careless not to even notice such an obvious thing. But when I bought it ,the circuit city saleslady took the box and scanned the price.

If it was so obvious, she should have noticed it too. I admitted that I should have opened and made
a thorough inspection. But do you open the package and check everything out when you buy anything, especially in the holiday shopping season? Not to say that the plastic sheeve outside the box is still there?And what if you are trying to buy a gift?

For the second point, I can prove to you that what you said doesn't make sense. As I said, I didn't even open the plastic sheeve. I guess you know, you need to cut the original UPC label from the box in order to send the rebate. what's more, I still have the rebate forms at my home.

Well, I learned the lesson from the circuit city.
I made some mistake. But I don't think it is reasonable for me to pay around 200$ ( the price before rebates and now I don't know if I should send the rebate or not) for sth I didn't do.

Your report raises a couple of red flags.

First of all, if there was really a floppy drive inside the box at the time of purchase, the box was obviously not shrink-wrapped per factory specifications. Why did you NOT open the box at the time of purchase, to inspect the item, make sure that everything was there and in "new" condition, etc. That was your first mistake.

Second of all, you mention how the hard drive was extremely cheap because of the rebate, yet you were going to return it anyway. You aren't one of those customers who buys an item, sends away for the rebate, and then returns the product later, are you?

Forgive me if I am incorrect, but it sounds to me like not only were you trying to get a FREE hard drive by swapping it with an outdated floppy drive and then returning to the store, but you were also out to get some cash via the manufacturer's rebate. It does not seem logical that it is anyone's fault but your own, especially since you foolishly did not open the box at time of purchase to make sure that the box contained everything you were paying for.
