Circuit City sold me a defective Verizon Audiovox and wouldn't take it back. If you buy a product and use the rebate, you forfeit any rights of returning it. Rebate Rip-off! Grandville Michigan

I bought this Verizon Audiovox phone a week and a half ago from Circuit City. It is obviously defective. I always have it on vibrate. Yet, sometimes it changes to no alert mode. Other times, it switches to ring mode and then back to vibrate. It doesn't always alert for voicemails. I just have to find out a couple days later. Furthermore, the speakerphone does not work. The volume is really low on its maximum setting.
About a third of my calls are dropped. My roommate who also has Verizon doesn't have this problem. Circuit City will not give me a refund without the UPC. I have the box and all of the materials. But, Circuit City had a mail-in rebate on the phone. Of course I got it off in the mail right away. Now, they won't take it back. That is complete fraud. Basically, Circuit City is saying if you buy a product and use the rebate, you forfeit any rights of returning it. If you want to be able to return it, you cannot use the advertised rebate. That is quite a little scam they have going. I do not want the same phone. I want a different brand. I don't need them to exchange it for another defective phone.

It was a Verizon rebate. It did require the original UPC. I have already cooresponded with Circuit City on this issue by e-mail and phone. KMM1319872I9552L0KM

The Circuit city Rebate Forms tates thata COPY OFTHE UPC BARCODE IS REQUIRED.
Not the ORIGINAL.
It also states for phones that a copy of your first months service agreement is required. Therefore, you can't send in right away, as you have to wait for your bill.
Now, let me ask, was this a Circuit City rebate, with the above requirements? Or was it a VERIZON rebate who does require the ORIGINAL barcode.
