I purchased an HP Color LaserJet 2550 printer at a reopened Circuit City in Southlake, TX (suburb of Dallas & Fort Worth), mainly lured by the $50 gift card offer. To make a long story short, the printer was defective out of the box. I returned it (with all manuals, accessories, etc.) the next day and was hit with a 15% restocking fee! Plus, they took back the $50 gift card and still charged me for that!

Now I paid $67.50 for the restocking plus $50 for a gift card that was revoked - that's $117.50 for a $499 printer. If you make the calculation, 15% of $499 should be $75, but I was also hit with that extra $50 which I content was stolen by Circuit City.

Restocking fees, especially for defective merchandise, are a joke. This is simply a way to extract money from customers, especially important when big-box consumer electronics retailers are having horrible sales years.

I will NEVER buy anything from Circuit City again. I hope they go Chapter 11 or are acquired by someone else and are dissolved.

Kelly's rebuttal seems unnecessarily aggressive, so please allow me to respond that his/her comments.

Kelly's first comment was First off you cant [sic] check if its the last one in stock an employee has to.

Response At the time I was using the CC web page, it listed that the printer was in-stock and there was only 1 left. Perhaps the web page protocol has been changed since then. Regardless, I did know prior to arriving at the store that there was only a single unit available at this particular location.

Response Since I paid by check, half of that statement would not apply. But Kelly is correct that the policies are listed on the receipt. However, I would offer that these should also be prominent at the cash register after all, if the policy is read after the transaction, it sort of defeats the purpose of caveat emptor (buyer beware). Others might say "closing the barn door after the horse has escaped".

Response Kelly is correct here, and I would not contest that. It was my decision as the customer to choose from those alternatives, but the person I spoke with did not give me all those choices. I guess he was not as informed as you are. (Maybe Kelly works for CC?)

Kelly's last comment was So your problem is not Circuit City's fault its [sic] yours because you were pissed and you wanted them to pull a printer out of thier [sic] butt for you. People like you that complain are just annoying so shut up and be more patient.

Response Wow! What an answer! Since Kelly is not familiar with my particular concern and is simply reading this online, he/she could not know me or my feelings. I suggest Kelly's last comment is irrelevant and should not have been posted by the webmaster.

The real point here is that all stores CC, Best Buy, etc. should drop the restocking fee for return or replacement of defective merchandise. This is a relatively new phenomenon that consumer electronics retailers (and others) are using to combat shrinking revenues. Congress, the Federal Trade Commission, and the Better Business Bureau have all individually raised these same concerns, so it cannot possibly be an isolated incident. This is not a customer friendly policy. I would not be surprised, however, that those who work on the retail side would probably disagree.

By the way, the [sic] that was added to Kelly's responses is nothing personal. Rather, it is simply a grammatical indicator of misspelled words. Just to set the record straight. Have a wonderful day!

Paul from Lakeland is incorrect.

First of all, I did not try to get the $50 gift card for free. The clerk rang up the original transaction incorrectly and the way the "refund" was handled was that I was charged the extra $50 but got nothing for it. I did NOT get the card then spend it then try to get a refund, "Pal".

Second, this printer was the only one in stock at this particular store (I checked). The way the return transaction was handled completely turned me off to Circuit City and its "customer service".

YOU get your facts straight, Paul from Lakeland. (You probably work for Circuit City.)

First of all, if your printer was truly "defective," then you wouldn't have needed a refund -- you would have simply needed to exchange it for another printer, in which case you would not have been charged a restocking fee.

In your case, you bought the printer to get the $50 gift card, spent the gift card, and then tried to return the printer for a full refund. Sorry pal, stores are one step ahead of you and know all the tricks fraudulent customers play. Next time, play by the rules and you won't have any problems.
