I leased a credit card terminal from CIT without knowing about a non-cancelable contract. My sales person disapeared before the terminal was completely set up. Now that I am not in buisness anymore I would like to get out of the payment.

When I called CIT, I found out that I have a four year contract that will cost me $130 per month, $6240, and still owe $4000. The only way to get out of this payment is to pay in full and send the machine back. My boss bought the same terminal online band new for around $300.

There has to be another way out of this. I thought about closing the account since it is the only buisness expence that I have left. I don't know how much trouble this would cause.

REPORT LFG AND THE MERCHANT SERVICE TO THE FBI

I am sorry you too have been a victom of this scam. The so called non-cancellable lease is a joke. LFG uses a form of smoke and mirrors, in other words you are duked into an agreement you didn't know you were getting into.

Then they start draining your bank in a different amount each month so you can't just stop payment on that amount, you must close your account. LFG and the many merchants they racket with are breaking the law.

They actually forged my contract. Extortion and racketeering are a federal offense. You must file a report with the FBI. It is very simple. You can do it on line.

I wrote letters to the FBI in Wash. DC and the office in Chicago. They will investigate the complaints. It is against the law to steal. It is a federal offense to steal by using any instrument of "interstate commerce" Also write a form letter to the 3 main credit reporting agencies before they report you. You must fight back do not be a victim.

If you signed a lease agreement, it was your responsibility to read the terms. If is was a non-cancellable lease, the terms would state that. The lease agreement would also state the monthly payment and # of months the lease was for. If you signed a blank lease agreement, they fault is with you.

You were the one who made the decision to use that vendor for your credit card machines. you can't blame the finance company. You chose the vendor, and they paid for the machines for you. now you owe the money.

If the machines don't work, try calling the finance company to see if they can provide you with an alternative vendor to finish setting them up. You owe the money to the finance company because they paid the vendor you chose for the equipment you wanted to lease. You say your boss got the same machine for $300. then you should buy it outright yourself.

When you lease, the price is always higher. Although I doubt a machine that is costing you thousands of dollars can be bought for $300. It is your responsibility to do your research before entering into any legalally binding agreement.
