Although you probably never signed an arbitration agreement, one exists, voiding a class action. You can file arbitration for Fair Debt Collection Practices Act violations, violations of the TCPA, and State Law, harrassment and more. I would file for a minimum of over $25,000 which is required for an in person hearing in your state.

Read that if you make a written request to their address in Irvine, they will pay ALL COSTS of arbitration, which begins at over $2,000 to start the arbitration. Add to that their expenses, the arbitrators expenses and the loss they will have in arbitration. Even if you lose, you can post the entire process on the internet. This company and their General Counsel, Mark Creatura, will soon be flooded with expensive arbitration.

hi I have contacted Charles E. Bradley on facebook, and sent this very letter to every high official in the united states, im in the process of starting a facebook networking group against the harrasement and breach of contract from cps to file a class action lawsuit. enjoy..
I really don't know who to contact, turn to, I have written this letter and sent it off to half the united states of america, from the president, to my local state attorney general, to every talk show, and news channel. So let me begin my brief story, it is about a auto/financial insitution called, "Consumer Portfolio Services, whose IL. office makes threats, harrases me, stalks my family and work. They are a auto loan insitituion that gives loans to individuals with not so great credit, or no credit at all. Anyone that has gotten a loan from them as they are trying to get a car, is at first excited? Happy they just got approved, but the dark side of this company, which i've never in my life had to encounter anything of the sort, is absolutely horrible. I am writing this in regards to getting the word out there to people who don't know who they are or what they are like, and for all the people out there that do/did have loans through them, that are pretty much, in a hole from day one. Consumer Portfolio Services as far as I know has 4 offices that service the whole united states with their headquarter office in
Irvine, CA and 3 sub offices in IL, FL, and VA, but also an office in phoenix az, which is not on their website. You can only find that address on your CPS bill and like the other 4 office's sites its a PO BOX , wierd dont ya think?, Well Ive done reserch and here is why, they have 4 alias names E Consumer Portfolio Services, Inc.E

We purchased a vehicle in 03 and due to the loss of a job and medical problems we gave the vehicle back. We sent the papers to them giving the vehicle up and we told that they would send someone to get it within a week. Well 5 months later and several certified letters later advising them to come and get their property they finally sent someone out, the vehicle had body damage and he refused to take it. 3 months later our house was sold and the new owners were taking over, we sent more certified letters requesting they pick it up and even sent one to the attorney they hired. The attorney had dropped them as a client and sent the letters to their legal department. When we moved the new owners allowed us a month to leave it there and finally asked us to remove it. We contacted a towing company and they took the vehicle and they contacted CPS. Now in the mean time CPS is calling all our "references" and telling them we owe money
, they call us and we tell them that we have sent certified documentation to them requsting they pick it up. One family member told them they (CPS) knew where it was and stop calling him and just go get it. One agent spoke to my then 10 year old and told him we were going to prison for theft. I grabbed the phone and unleashed on them using and the girl told me I couldnt cuss at her, I told her as long as she called me I can say anything I want and she hung up.
This has been going on for YEARS now, they were advised that we had moved out of state and that the vehicle was left behind before we had it towed, yet they tried to file suit in the state we no longer lived in, this was kicked out by the judge. They continue to call my husband at work and had managed to get our home number using a data base that Fedex uses. We have changed the number and no contact only at work and via mail requesting the
loan be paid or else. I spoke to attorneys in both states and both advised that since we had tried for so many months to make them take it and they didnt we had the right to remove it when the house was sold. Even with body damage they were required to pick it up and then after auction we would be responsible for the rest of the loan. Says this happens all the time. My husbands legal dept is getting involved and sending them a letter to stop harrassing not only my husband, but his supervisors at his place of business or they will take action since it is recorded for the past 4 years.I have found the only way to "deal" with them and their rudeness is to be just as aggressive and rude back and most times they hang up after you make a personal attack on them verbally. They cannot handle it and prey on the weak. I am still looking at what we can do since we cant afford an attorney to sue for harrassment. I have filed with my state attorney general in case others have too.
The one thing I regret is the purchase of the vehicle. I see now that the
finance guy was grabbing the first one and after learning about all the back door payouts that finance companies have with dealers, I am sure the finance guy got his commission. and millions more out there, its not fair how we are treated, its one thing for american ppl to be late on a car payment, but to forcefully take the car, lie, harass them, hang up on us, threaten us, swear at us, I'm done and want to see some sort of resolution to this now..even if i am wrong that once mercury finance company in california, illinois, az, and flordia is now the financing company, and consumer portfolio, also mercury came back with another name called MFN, so will someone in this world help all the people in america as to why we have to go through this, with a auto loan company, one complaint i read the guy had to quit his job due to stress of being harrased, one lady was disabled and said she was waiting on her disibility check, and they said thats ok they will take that. they violate code, BREACH OF PEACE, BREACH OF CONTRACT, they over charge so much that the american people are not getting a second chance, they are being ripped off, by paying for a car loan for 10 years, my car is a 06 kia, my loan was $11, 000 really?? and 2 years later i still owe almost $9,000 it states its for low income, or bad credit, but when someone loses a job, and still has money coming in, they WONT REFINANCE AND LOWER PAYMENTS, they ARGUE on the phone, I had a screaming match with a "office manager" in the IL. office and she hung up on me. YES HUNG UP ON ME, then called me back on my cell phone for 2 hours, just kept calling, like she was stalking me. also they call your work and give out all ur personal info, and want to know why you havent paid, and where you are, and even will yell, or get smart with your manager, your family, THEY USE your social security to find info, I changed my address on their website and phone # because they were really stalking/harrasing me, and THEY FOUND IT..how???? please someone look at the stuff below, reserch it help me, to help other figure out how to stop them. we american people do not need this abuse from a AUTO LOAN COMPANY..I will rather ride my sons skateboard, but untill then, they need to be exploited. also I sent the president of the company a facebook letter, his response was "I STOPPED RESPONDING TO EMAILS LIKE THIS YEARS AGO". really???? please someone help

I never stated that NO attorney would file a case without money upfront.
SOME will.
My point was that Melissa stated that NO ATTORNEY would require money upfront in a lawsuit-that simply is not true at all.
MOST attornies DO require some money upfront before filing a civil lawsuit. That is MOST, not all.

You are wrong - My attorney took my case with NO money upfront period, sued the scum bag collection agency and we won -
There are attorneys who do take cases on a contigency bases
As for suing a car dealership - good luck - you are gonna need it to find anyone who wants to take a case where there is no merit

I am unemployed in Michigan with 15.2% unemployment and now the car i purchased needs a second tranny, at 86,000 miles. I cannot afford to fix the car and make the payements on something that is undrivable. Yesterday My mother recieved a phone call at her home about repossesion of the vechile which I am fine with. But told her she is the co-signer for this loan which she is not. I will have conversation with them to take vechile and file benkruptcy myself. My mother just recently had a heart attack and does not not need this stress. CPS bite my *** take your car. You rude people calling try to come and get a job in Michigan there is none. It is more important to me to keep my home, food and utilities rather then your car. I also contacted Ford with no help and BBB and they said that I have no case. So take it and try to garnish me I am ungarnishable becaus I am not working.
I will be happy to join your lawsuit!!!

No Attorney will make you pay fees up front in a Law Suit.""
Incorrect. MOST attorneys will require at the minimum, the court fees upfront before filing a lawsuit on your behalf in addition to a retainer.
Some attorneys, in the case of a "slam dunk," will work for a contingency fee-they will not charge you their fee until you win the suit and then they claim a percentage of the award.
HOWEVER, it cost money to file a lawsuit in ANY jurisdiction and MOST, if not all, attorneys will require the plaintiff to front the court costs, filing fees, administrative fees, etc. In class action lawsuits, the LEAD PLAINTIF(S) get a substantial award (for fronting the costs and assuming the RISK) while the class members receive a pittance.
And finally, there are those HONEST attorneys who after evaluating your situation, determine you DO NOT HAVE A CASE and simply will not represent you. The unscrupulous attornies will represent anyone, with the fees PAID UP FRONT of course.

What are the legal grounds for your "magical" class action suit?
If you really think you have a case you should go after them on your own and not wait for other people. If the courts think it deserves "Class" status they would grant it and you could be the lead. Of course you will need to find a lawyer, and due to the nature of the case they are going to ask for at least a couple thousand dollars up front.
