My father and deceased mother (since 2004) had their car loan through CPS. CPS repo'd the car and sold it at auction in 1998. CPS started to garnish my dad's wages in 2009. He got court order to stop the wage garnishment due to financial hardship. They stopped after taking $1500 from them. This was more than what was owed. The wage garnishment started again and my father has paid more than $4000 and still owes another $1000. My dad works part time and with the wage garnishment -my sister has had to pay his rent for 3 months and there is no end in sight. There has never been any papework sent to my father the company had old address and phone number. When calling the company you are transferred to several departments then are told to contact their legal department at yet another department. Legal doesnt answer the phone which in turn you have to leave a message and they dont call you back. According to my fathers employer they received the court order to garish wages which again my father was told or advised- in writing or by phone.

The car was auctioned and that applies to the debt. The court paperwork shows only owing 750.00 yet to date they have garnished over $4000. The court waived over $3000. 3 years ago yet they are still garnishing the wages.

Whether you like it or not, when the payments are not paid, collection activity starts and leads to a repo. The repo doesn't make the balance go away. What does the paperwork from the court say? It will tell you the exact amount to be garnished and the schedule.
