I will try to make this short and sweet....
About 2 months ago....i mysteriously got a call from CARD SERVICES saying my credit account had been past due.....since NOVEMBER (4 months)

So i went on line and checked my payments and all was well..... I called BANK OF AMERICA and soon figured out that the two credit cards I had with them when making my payments on line ......WERE ONLY GOING TO ONE CARD.
So the rep at BANK OF AMERICA said ok lets fix this....
we sat down for over an hour and he saw what i saw.... double payments to ONE card... so he said ok..i am going to fix this....he took over 400 dollars worth of payments and late and overage fees off and said it was credited to my other card. I was so happy...no more calls........

NO SO.....I continued to EVERYDAY get one to three phone calls from CARD SERVICES....as early as 830 am and as late as 937 at nite..... when i proceeded to tell them about what happened they said that is NOT what their pc screen said and they just want there money. the calls continued and i continued to answer EVERYDAY and tell them the same story. they continued to say OK miss.......... I will put a note in the system saying NOT to call you. the calls CONTINUED.
Now my phone bill was 200 dollars from calling and accepting their call ALL the time....
SO i called BANK OF AMERICA where finally a rep STAYED ON THE PHONE with me and helped me to situate this ....
he said give it a week and all will be well.
THE CALLS continued. i will admit i did get frustrated and yelled and carried on but that was only because I knew I WAS NOT wrong.

Finally on MARCH 6th, I was fed up they(CREDIT SERVICES) called me again.....and I gave it to them. At the end of the work day I was called into the office and FIRED because a DEBT COLLECTIONS office called, my boss said.
I called CARD SERVICES to let them know they caused me my job and as well called bank of america. CARD SERVICES didnt care and i continued to tell them that this was BANK OF AMERICAS mistake and they need to call them.
THEY REFUSED and said they cannot do that. So here i was caught in the middle....... I called bank of america and told them my situation and all i was told was ....YOUR CARD is coming out of collections and we will write and APOLOGY letter to your job....lolololol.lol...
Like that would make everything better and I would get my job back....

lol lol...

The card services calls continued until i LITERALLY tracked down that BANK OF AMERICA representitive who assisted me the last time...... and NOW after a 200.00 phone bill, a LOST JOB and tons of stress and nites of CRYING ..........HE FINALLY FIXED the PROBLEM.......
my question is.....AM I entitled to lost wages? payment for the excessive phone calls to my phone? what am i entitled to ?

THIS was a mistake made on BANK OF AMERICA and CARD SERVICES NOT COMMUNICATING with one another, even thought CARD SERVICES WORKS for BANK OF AMERICA.....now my credit report is ruined after just starting and KEEPING it in good standing.

bottom line is ....NOW I LOST MY JOB...the card will go into collections anyway after fighting to get it out when it wasnt even supposed to be in there......
CAN SOMEONE HELP ME?

Stacey, this is exactly why you NEVER speak to a third party debt collector!! And..

Stacey,

This is exactly why you NEVER speak to a debt collector on the phone!! Always get it in writing. A phone call will never preserve your rights unless it is recorded.

And, upon first contact by a third party debt collector, IMMEDIATELY send a CEASE COMMUNICATIONS request as per your rights under the FDCPA.

Now, when they violate your LEGAL request, you sue them under the provisions of the FDCPA. You can get up to $1000 in punitive damages, plus costs. And, you can get actual civil damages too. However, all of these actions must be initiated at your own expense.

Also be sure to file complaints online at ftc.gov for the FDCPA violations.

You brought most of your problems on yourself as you did not assert your rights.

As far as your job loss, it is unlikely you would lose your job over a debt collector calling one time as you stated. Either that job was not worth keeping anyway, or they were already looking to get rid of you.

but that phone number is of a collection agency...not "card services".
