Diet Patch Company charged my credit card 89.95 for "so-called" FREE Trial of their Diet Patch,I never knew how much it would cost, because it never stated it any where. I looked specifically for that peice of Internet, Arizona

I answered an Ad on the internet to try a "Diet Patch" method of losing weight.  The Ad said it was a FREE 30 day trial for $1.95 shipping and handling.  this was credited to my checking account on 12/27/11. After receiving them I looked for how much it was going to cost if I wanted to continue the program and there was nothing in the package that gave any information at all.  I never saw a price for this product anywhere.  If I had seen how expensive it was I never would have even tried the product.  Then I noticed on the 10th of January my credit card was charged $89.95 for Diet Patch.  I never received anything, I was just charged.  When I called the company this morning at 10:25 am, I told them I never received any patches.  The man I talked with said "Let me find the tracking number!"  What I was being charged for was the "FREE Patches, because I didn't call them and cancel the product.  He said I had to do it within 14 days after receiving them.  At that point I hadn't even tried them yet.  I told him I wanted my money back and he said the best he could do was give me 35% of the cost back.  I asked to speak to his supervisor and he said he was as high as I could go.  I asked him for his name and he said Chris, Agent #3.  I asked if I could speak to someone else and he said they couldn't do any more for me.  I told him I definitely did not want any more patches.

I am really upset by this because I feel this whole scheme was false advertising. They never came out and said how much it was and the guy I spoke with told me I had agreed to it when I checked the box that told how much they cost.  I did no such thing.  I never would have agreed to something that expensive because I am just weeks away from retirement and would not have that kind of money to spend, especially if that was what it was going to cost each month. That's more than I spend on my regular prescription medicine in a month's time.  I know I specifically looked for a price and there was none.  There was also no information on the product when I received it.

Customer Signed Up For A Trial

Customer signed up for a 14 day trial, agreeing to the terms and conditions that they would be billed the full price if they did not cancel before the 14 day trial period had ended.

Customer can see the last step of the order page here that shows the terms and conditions box is required to be checked (Also notice the condensed version of the terms to the left of the page as well):

The full terms and conditions the customer agreed to are located here (They can also be clicked on on the order page, on the home page, and in the email sent to the customer after their trial order was placed):

The customer was sent the 14 day trial and the product was delivered to the customer.

Customer did not cancel within the 14 days like agreed to if they did not want to pay for the product and was charged the full price for the product.

The trial period does begin on the order date and that is disclosed both on the order page, the terms and conditions that are required to be agreed to, on the main website, and a link to the terms and conditions are emailed to the customer with their order. We extend trials all the time for people who email or call in before the 14 day window has passed and are always happy to give customers more time to try the product.

We also allow customers to return the product if it is not used for a refund if that is what the customer wishes to do. We do not do anything that is not disclosed on our website, is required to be agreed to before placing an order, and is sent to the customer.

I understand the Arizona's side but if he is talking about the dietpatchtoday.com site, I looked at it and entered my info and when I was putting in my credit card info, I about checked the box that said "I certify I am 18 years of age or older and agree to the terms and conditions of this trial order."  I then read the details section on the same page.  It went over the basics which told me everything the supervisor told Arizona.. I opened up the full terms and conditions link and read them.  I did not want to agree to them so I didn't check the box and as a responsible consumer who actually reads what I am agreeing to, I spared myself the embarrassment of complaining after the fact and blaming a company for holding true to what it said it was going to.  Good luck but in the future you should probably have an adult with you when you order things off the internet.
