 Even after a jury found no fraud on my side and ordered Erie to pay, they still refused. Only after my attorney won a motion to charge them interest did they pay 6 months after the trial....

Talk about a BAD FAITH insurance company!!!  After Erie Insurance Slandered me and dragged me through a JURY TRIAL, the the Jury unamously finds in my favor!! Erie Insurance Being the Billion Dollar Bullies they are is still refusing to pay, Now they are sueing for a new trial because they did not like the Jury verdict.  

  3 years after a fire where I lose my entire home and after a Jury finds I have done nothing wrong Erie insurance continues to slander me and will not do the right thing.

JUDGMENT

This matter was tried before a jury of twelve persons in the Wilson County Circuit Court on September 18, 19, and 20.

At the close of the proof, both sides moved for a directed verdict on the grounds set forth in the transcripts of the trial. The court denied both sides’ motions for directed verdict.

Thereafter, the jury deliberated and returned a unanimous verdict in favor of Defendant/Counter-Plaintiff DAVID SARTI. The jury verdict form has been filed in this cause and a copy is attached to this judgment as Exhibit 1 and is hereby incorporated by reference as part of this judgment. The court polled the jury after the reading of the jury verdict and confirmed that the jury verdict was the unanimous verdict of all twelve jurors.

Prior to jury deliberations, the parties agreed that if the jury found for Plaintiff Erie on the Jury Verdict Form, then no award would be made to Defendant/Counterplaintiff Sarti. If the jury found for Defendant/Counterplaintiff Sarti on the Jury Verdict Form, the amounts awarded would be as follows:

1. With respect to the fire claim of November 6, 2015, the house was a total loss. Since the insurance policy had limits of $165,000 on the house, and the replacement cost of the contents submitted exceeded the policy limits of $123,750, those amounts would be awarded on the fire claim;

2. $2,110.00 would be the amount awarded on the first theft claim if the jury found for Defendant/Counterclaimant;

3. $3,582.22 would be the amount awarded on the second theft claim if the jury found for Defendant/Counterclaimant.

The court approves the jury verdict in full and finds the jury verdict is supported by the weight of the evidence presented at trial.

Accordingly, it is ORDERED, ADJUDGED, and DECREED, that DAVID SARTI is awarded a judgment against ERIE INSURANCE EXCHANGE in the amount of $294,442.22 (Two Hundred Ninety-Four Thousand Four Hundred Forty-Two Dollars and 22 Cents), for which execution may issue.

It is further ORDERED, ADJUDGED, and DECREED, court costs in this matter are taxed to ERIE INSURANCE EXCHANGE, for which execution may issue.
