I have read must of the complaints, and I agree with the others who feel this is not a rip off. I made sure I read ALL of the small print before accepting this credit card. YES.... ALL the fees...Auto Draft charge $5.00-$9.00, Copying fee $3.00 per item...Internet Access Fee 3.95 and the 25.00 fee for credit increase and others, that everyone is complaining about are on the document.

ALL this is on the document I was sent BEFORE accepting the card. All the fees are repeated several times in the document...how did these people miss it. I think it is a joke for people to complain about something that they did not take the time to read over and investigate before accepting.

YES, they have high fees, but that is a price I have to pay to rebuild my credit. I have my card and I am being responsible in using and paying it so that I don't not to incur the fees. This card was not given to me to improve my life style. It was given to me to improve my credit. It cost me .37 cents to MAIL my payment on time.

If you want a card with out all the fees keep trying to apply for one, but if your credit is bad it will never happen. Until you take a chance and be responsible for one that has all the fees.

Maintain it for 6 months to a year and then try again for another card. What are you people complaining about. Someone is giving you a chance, at a cost, but you will have to start somewhere.

I recived my card yesterday with a contract and discloser that states that if I use the card, I give up all rights to sue in any class action suit or any other suit for that matter.

it also states that the card is activated... THANK GOD IT WASN'T LOST OR STOLEN IN THE MAIL.
it states that if i dont use it for 30 days it will automaticly activate and i will be liable for all fees and that if i dont agree to the contract, cut the card in half and return it to cancel the acct. but dosn't give an address to return it to, that address will be furnished with my first billing statement..

i ask you what hounest bank? would send a card that is already activated, and anyone could use thus activating my acct and holding me liable. or not include thier return address so i can cancel before the 30 day deadline.

i called them on the 800 number and was given the runaround by 2 different reps for 15 mins. before i got the address to return the card, before using it.

it cleary states in the contract that to cancel the acct. before using it, that the card must be cut in half and retuned to them at the address to be sent with the first billing statment.

that im sure i wont recive untill after 30 days.

the rep i spoke to said that she could cancel the card by phone , just cut the card in half and throw it in the trash, and she would send me a paper to sign canceling the contract and acct,

hmmmm i wonder how long the paper will take to get here and if returned right away how long before they open it and cancel the acct.

more than 30 days im sure

The Upside of Anger

Is First Premier Bank a rip off? Yes. Any moreso than any other credit card company? No. Given the nature of our society, being taken advantage of by big businesses that encourage enormous consumer debt is par for the course.In the case of First Premier Bank, I've found that there is an upside. My credit rating was poor (and still now could only be called Fair at best). I never had to file bankcruptcy but aside from a couple of low limit retail cards, I could never get a real credit card with a significant limit from a major bank. One year ago, I signed up for a FPB card. I knew about all of the fees and that I was paying the equivalent of my so-called credit limit for the improvement of my credit score. I paid on time by mail, used the card scarcely (making sure that the equivalent of the participation fee for a few months was always available) and always made sure money was in my checking account to cover the payment (most companies use electronic check debits for payments these days so it is NEVER wise to take chances). One year later, I have received a real credit card from a major bank with a $2,000 limit and my FICO score has improved by 60 points. For me, it has been $350 well spent and I am the road to credit recovery. Certainly, there are alternatives - i.e. secured cards - but taking it for what it is, there is certainly an upside to being a FPB customer.

not a ripoff

Believe me. As someone who has had to deal with rip off artists in the past I can safely say that First Premier does not fall into that catagory.

I have had a horrible experience with another company (see my story under Cross Country Bank) and believe me when I say that First Premier is nothing like them.

I was well aware of all of the charges that would be on the card at the time that I received it. I was also well aware of all of the fees that would apply to me. It was all spelled out in the documentation that was sent to me by First Premier.

I've had the card for a few months now and have had no problems with them. (Again see my story and others about Cross Country Bank for a comparison). My payments have been applied in a timely manner and I have incurred no fees that I was not plainly aware of.

I Agree. They are not our friends!!!!

This card company does charge outrages fee's and Yes, some of you are right in saying, that if we did not mess up in the first place, we would not need a card company like this one to rebuild our credit. But, I also do not think that they have the right to treat us like crap.

We are still customers and as such should be treated like a customer! If they call to collect payment that might be a couple of days late, they should not be able to give my husband a hard time and tell him to pay the bill, and that if he says he will give me the messages, that he is refuseing to make payment. They then said to him, "Well didn't you benefit from the dinner at so so place and shopping at such and such store.

That is not professional behavior!!! I do not care how much we messed up in our past, we are still paying the bill, and tring to rebuild our credit does not mean, make us feel like dirt....

I totally agree with Sherri in California. We got the card first and about 2 weeks later, got the paperwork. We had not even activated our cards and already had a nearly $200 balance. We have used once and paid off last week and now they tell me there is a hold on payment for another 15 days and may be availible then. This is not right. For those comments stating that if we had not poorly handled our money we would not be in this boat, Yes, I take offense. You see, I did not poorly handle my money. My Child was born very sick therefore resulting in astronomical medical bills which sunk me. So, you see, I do take offense at that comment because I do not think that medical bills is handling your money badly.

First Premier is NOT your friend

Yes, you should read the disclosures. But they don't send you the disclosures until they send the card. And good luck "not accepting" the card, because as far as they are concerned, once they mail it, you have accepted it.

Oh, and our credit is FAR from "bad". In spite of First Premier, we just purchased a house. The mortgage lender told us that First Premier has a reputation of being a "rip-off card" and that they don't pay attention to them. It did also help that we are able to PROVE they were ripping my husband off.

I think beggars can not be choosers concerning this matter. You all may complain about charges that were clearly stated on all of their paperwork. but to regain control of your credit is a hard thing to do.

I totally agree with Dallas, Texas in what they had said.

Try and find another credit card that will give you credit for your credit statement on your Equifax credit report and other reporting companies. No one will.

I to have a First Premier Card. If and when there is a problem or I to think there is a problem

I call them to find out maybe if it's an over charge and then its explained to me clearly. That is what they make telephones for.

Another thing I had done was keep any and all stubs off the original paperwork that I had sent in, this is to refer back on as well.

My account is paid in full every month to rebuild my credit that much faster all though I do not use this
Credit card that often due to not wanting high premiums to pay. I limit my spending and do not max it out,

My husband doesn't know I have a credit card for he is Mr spend a lot. So I hide it from him. I only keep my credit card for emergency purposes, (car break downs, groceries when our finances doesn't allow, bills that need to be paid in a hurry, medications if I do not have enough money with me, etc.). Yes it's nice to have anything you want but you will pay in the long run. I don't want to do this, nor do I want to jeopardize my newly found credit, good credit that has gone on my credit report.

This is what being responsible is. You only have once chance in life to change your habits and ways and this is my one and only chance in life to show I am a responsible person concerning spending with a credit card.

Extra fees or not, At least I have new found credit that I am establishing myself where as no one else would even think of giving me another credit card from the past,. including Providian card services whom told me that when I paid off that card no they are not going to give me another one.

I for one feel very lucky that some one is taking a chance on me to let me reestablish my credit.

Just a little reality check for everyone

I am aconsumer who owns two of these cards. All I have to say is that,

1. If we hadn't abused our credit in the first place we wouldn't be here.

2. I completely read all disclosures and called the company with questions if I was unsure and new about all the fees before I accepted the terms(even though they are a bit much)(this was ).

3.If some of you din't thouroughly read all the terms before accepting that's another part of your irresponsibilty that got you here. You never accept anything without reading and understanding any and everything.

4.Lastly, be realistic w/ all the people out her w/ bad credit I'd want in on a business such as this myself. Face it, if you abused your credit you will never get a 8% interest rate,no monthly fee, $25,000 limit platinum card until you get your credit straight. Consequently, these types of cards are our only hope (if you're serious).

Yes, these cards rip your wallet off at first. But a rip-off, No! But, once you pay those fees off use the card wisely(to build credit). Not to charge everything in site and then complain once those interest rates and fees start kicking in.

Just a little reality check for everyone. No disrespect intended and not to be taken personally

People READ THE DISCLOSURES

I was checking out another company through the rip off reports when I came across all of these complaints about First Premeir Bank. First I must say that alot of these complaints could have been avoided if people would read disclosures on their credit card agreements.

Let me also add here that many people probably dont read the disclosure for "good credit" credit card offers either.

In fact many people reading this dont realize that when they signed those credit card applications and accepted the card (first premeir or not)they have given that company the right to pull a copy of their credit reports anytime the company wants as often as the company wants, without notifying the cardholder. Duh people this is why even if you make all your payments on time but have been late on other accounts your interest rates go up.

Also when you accept most credit cards you are accepting to abide by the "arbitration agreemnt" contained in the disclosures. Which states typically that you will not take part in CLASS ACTION suit against that card company and that you waive your right to a jury trial.

First Premeir is not the only credit card company that has very high fees associated with approval of an account. Many second chance banks offer similiar programs to help people rebuild their credit. Now I will admit that their are certain complaints in here that are valid (fees for returned payments that were never authorized to begin with etc) I have two more things to say before I'm done. (1) We as citizens in the US owe over 5.2 trillion dollars in consumer debt (credit cards and signature loans) with bankruptcy laws changing and more that 21% of cardholders defaulting on their accounts. The number of people who need a second chance is going to increase. (2) Banks are in business to make money. They raise interest rates to make people default on their accounts. This way the bank collects insurance money, gets a tax deduction of $2 dollars for every $1 that you default on. then turns around and sells your debt to collections for 25-35 cents on the dollar. Remember this BANKS NEVER LOOSE MONEY ON A CREDIT CARD ACCOUNT

Program Fee: We impose a one-time Program Fee of $95.00. This fee allows us to issue an unsecured card to consumers who may not be eligible for other unsecured credit. The Program Fee is a FINANCE CHARGE.

Internet Access Fee: We impose a fee of $3.95 for Internet Access to your account. This is a one-time fee, which will only be assessed after you have agreed to this service. This fee is a FINANCE CHARGE.

Credit Limit Increase Fee: When we approve your Account for an unsecured credit limit increase, a Credit Limit Increase Fee of $25.00 is imposed. This is a one-time fee, which is automatically assessed only with the first approval of your credit limit increase, which could be as soon as six months. This fee is a FINANCE CHARGE.


Express Delivery Fee: We impose a $25.00 fee for the express delivery of your Card(s) sent Priority 2-day airmail. This service is only available on lost, stolen or replacement cards. This fee is a FINANCE CHARGE.


**Auto Draft Charge: We impose a $9.00 charge for each payment you request through an auto draft service we provide. Autodraft payments requested through our automated systems (i.e. Voice Response or Internet) are assessed $5.00 per transaction. This fee is a FINANCE CHARGE.

Authorization: You certify that all information given in this application is true and correct and you are giving this information in order to obtain credit and authorize First PREMIER Bank ("Bank") to obtain information concerning any statements herein. You agree to furnish the Bank with all requested information. You authorize the Bank to charge the Account Set-Up Fee, the Program Fee, the Annual Fee, monthly Participation Fee and Additional Card Fee (if applicable) to your Account.



Qualify For Future Credit Limit Increases: You will be eligible for consideration of a credit limit increase after 6 months. You will automatically be charged a $25.00 fee upon approval of your first credit limit increase, which could be as soon as six months. This program is designed to allow individuals to increase their credit limit by establishing creditworthiness with First PREMIER Bank.

Refund Disclosure: Your Annual, Program, Account Set-Up, monthly Participation and Additional Card Fee are membership fees for truth in lending purposes. When your Account is approved, you will be sent a cardholder contract containing all of the terms applicable to your Account. If you elect to close your Account(s) within 30 days of receiving your cardholder contract and before you make any additional charges to the card, the Annual Fee, Account Set-Up Fee, Program Fee, monthly Participation Fee and Additional Card Fee (if applicable) will be refunded to you. You may have the one-time Credit Limit Increase Fee refunded upon request within 30 days of billing, which will result in a reversal of the credit limit increase. After this 30-day period these fees are no longer refundable and you are responsible for the account.

ARBITRATION: If you are issued a credit card, your cardholder contract will contain a binding arbitration provision. In the event of any dispute relating to your credit card or cardholder contract, the dispute will be resolved by binding arbitration pursuant to the rules of the National Arbitration Forum and both you and we agree to waive the right to go to court or to have the dispute heard by a jury (except in regard to any collection activities on your account). You and we will be waiving any right to a jury trial and you also would not have the right to participate as part of a class of claimants relating to any dispute with us. Other rights available to you in court may also be unavailable in arbitration. When you receive your cardholder contract you should read the arbitration provision in your contract carefully and not accept or use the card unless you agree to be bound by the arbitration provision.



YOUR BILLING RIGHTS: Keep this notice for future use. This notice contains important information about your rights and our responsibilities under the Fair Credit Billing Act.

Notify Us In Case Of Errors Or Questions About Your Statement. If you think your statement is wrong, or if you need more information about a transaction on your statement, write us on a separate sheet at the address listed on your statement. Write to us as soon as possible. We must hear from you no later than sixty (60) days after we send you the first Statement on which the error or problem appeared. You can telephone us, but doing so will not preserve your rights. In your letter, give us the following information: Your name and Credit Account Number; and the dollar amount of the suspected error. Describe the error and explain, if you can, why you believe there is an error. If you need more information, describe the item you are not sure about. If you have authorized us to pay your credit card bill automatically from your savings or checking account, you can stop payment on any amount you think is wrong. To stop the payment, your letter must reach us three (3) business days before the automatic payment is scheduled to occur.

Your Rights And Our Responsibilities After We Receive Your Written Notice. We must acknowledge your letter within thirty (30) days, unless we have corrected the error by then. Within ninety (90) days, we must either correct the error or explain why we believe the statement was correct. After we receive your letter, we cannot try to collect any amount you question, or report you as delinquent. We can continue to bill you for the amount you question, including FINANCE CHARGES, and we can apply any unpaid amount against your credit limit. You do not have to pay any questioned amount while we are investigating, but you are still obligated to pay the parts of your statement that are not in question. If we find that we have made a mistake on your statement, you will not have to pay any FINANCE CHARGES related to any questioned amount. If we didn't make a mistake, you may have to pay FINANCE CHARGES and you will have to make up any missed payments on the questioned amount. In either case, we will send you a statement of the amount you owe and the date that it is due. If you fail to pay the amount that we think you owe, we may report you as delinquent. However, if our explanation does not satisfy you and you write us within ten (10) days telling us that you still refuse to pay, we must tell anyone we report you to that you have a question about your statement. And, we must tell you the name of anyone we reported you to. We must tell anyone we report you to that the matter has been settled between us when it finally is. If we do not follow these rules, we cannot collect the first $50.00 of the questioned amount, even if your statement was correct.

Special Rules Regarding Credit Card Purchases. If you have a problem with the quality of property or services that you purchased with a credit card, and you have tried in good faith to correct the problem with the merchant, you may have the right not to pay the remaining amount due on the property or services. There are two limitations on this right: A) You must have made the purchase in your home state or, if not within your home state, within 100 miles of your current mailing address; and B) The purchase price must have been more than $50.00. These limitations do not apply if we own or operate the merchant, or if we mailed you the advertisement for the property or services.

Your Liability For Unauthorized Use Of Your Card. You will not be liable for unauthorized use of your Card. However, to protect your rights, you are required to notify us orally or in writing as soon as you are aware that your Card has been lost, stolen or used without your consent. Certain exceptions apply and you may be liable for up to $50.00.

Information Sharing: The following describes your agreement with us with respect to information sharing. By requesting, obtaining, or using a credit card from us you agree that we may release information in our records regarding you and your Account: to comply with any properly served subpoena or similar request issued by a state or federal agency or court; to share your credit performance with credit reporting agencies and other creditors who we reasonably believe are or may be doing business with you on your Account; to provide information on your Account to any third party who we believe is conducting an inquiry in accordance with the Federal Fair Credit Reporting Act; to share information with our employees, agents or representatives performing work for the Bank in connection with your Account; or to communicate information as to our transactions or experiences with you to persons or entities related by common ownership or affiliated by the corporate control or with any third party (including non-affiliates). Payment Protection Plan:

During the months when you have a credit card balance, the monthly cost for this coverage is 75 per $100 of your ending monthly balance. This charge is automatically included on your billing statement each month. Of course, during months when you have no balance, there is no charge. Coverage is only available to cardholders with accounts in good standing.



After your enrollment form has been processed you will receive a personalized certificate explaining all benefits and provisions of the Payment Protection Plan. The effective date of coverage will be shown on your certificate.

All coverage ends at age 71.

All benefits are based on your account balance on the date of loss and do not include amounts (including insurance charges) added to your account after your loss. The monthly benefit payment will be calculated by multiplying your account balance on the date of loss by the minimum payment percent required by the creditor. The monthly benefit payment may not be enough to pay the required minimum monthly payment on your account balance.

Life and Disability Insurance benefits are payable up to the sum of your unpaid account balance at the time of loss or $5,000, whichever is less. Unemployment and Family Leave benefits are limited to 9 monthly benefit payments for each payable claim.

Life Insurance does not cover suicide during the first 6 months of coverage (This does not apply to residents of MD, MA, MS, and VT.) Disability Insurance does not cover losses caused by: normal pregnancy or childbirth; any intentionally self-inflicted injury; or a pre-existing medical condition. A pre-existing condition is one for which you saw or were under treatment by a physician or chiropractor both within the 6 months before and the 6 months after the effective date of coverage. Family Leave Insurance covers unpaid absences from full-time employment while you or your Co-Insured are: caring for an immediate family member with a serious medical condition, caring for a newborn or adopted child for up to 3 months, on active military duty due to mandatory recall, on jury duty, or residing in a federally declared disaster area. Family Leave Insurance does not cover losses caused by a pre-existing medical condition. A pre-existing condition is one for which you saw or were under treatment by a physician or chiropractor both within the 6 months before and the 6 months after the effective date of coverage.


You, your and Designated Cardholder refer to the primary insured cardholder.

Coverage is not available to those residing outside the USA.

The program is administered and underwritten by Central States Indemnity Co. of Omaha and also underwritten by Central States Health & Life Co. of Omaha, both of Omaha, Nebraska.
Plan Modifications

In AZ the insurance does not terminate; instead, the Life Insurance changes to Accidental Death Insurance at age 70. In CO, OR, PA, SC and TX, your plan includes only Life, Disability and Unemployment Insurance at a cost of 57.4 per $100 of your ending monthly balance (48.5 in CO, 57.2 in OR, 48 in PA; 44.9 in TX). In VT, your plan includes only Life, Disability and Family Leave Insurance at a cost of 40.9 per $100 of your ending monthly balance. In AL, CA, ME, NC, SD and VA, Family Leave benefits are limited to 6 monthly benefit payments (3 months for Family Leave in AK, CT, HI, MA and NH) for each payable claim. In MA, disability benefits begin on the 31st day following the date of loss. In MD, the Co-Insured must be your spouse. In NJ, you must be eligible to collect unemployment compensation benefits through the New Jersey Department of Labor to in able to receive Unemployment benefits. In NY, coverage is available to you, however, a special form is required. Call 1-800-445-6500. In PA, only the Primary Cardholder is covered for Life Insurance benefits. If you wish to purchase these coverages separately, call 1-800-445-6500. I was checking out another company through the rip off reports when I came across all of these complaints about First Premeir Bank. First I must say that alot of these complaints could have been avoided if people would read disclosures on their credit card agreements.

Let me also add here that many people probably dont read the disclosure for "good credit" credit card offers either.

In fact many people reading this dont realize that when they signed those credit card applications and accepted the card (first premeir or not)they have given that company the right to pull a copy of their credit reports anytime the company wants as often as the company wants, without notifying the cardholder. Duh people this is why even if you make all your payments on time but have been late on other accounts your interest rates go up.

Also when you accept most credit cards you are accepting to abide by the "arbitration agreemnt" contained in the disclosures. Which states typically that you will not take part in CLASS ACTION suit against that card company and that you waive your right to a jury trial.

First Premeir is not the only credit card company that has very high fees associated with approval of an account. Many second chance banks offer similiar programs to help people rebuild their credit. Now I will admit that their are certain complaints in here that are valid (fees for returned payments that were never authorized to begin with etc) I have two more things to say before I'm done. (1) We as citizens in the US owe over 5.2 trillion dollars in consumer debt (credit cards and signature loans) with bankruptcy laws changing and more that 21% of cardholders defaulting on their accounts. The number of people who need a second chance is going to increase. (2) Banks are in business to make money. They raise interest rates to make people default on their accounts. This way the bank collects insurance money, gets a tax deduction of $2 dollars for every $1 that you default on. then turns around and sells your debt to collections for 25-35 cents on the dollar. Remember this BANKS NEVER LOOSE MONEY ON A CREDIT CARD ACCOUNT

FINANCE CHARGES are imposed on cash advances from the date the advance is made until it is paid in full and there is no grace period in which you may repay a cash advance to avoid FINANCE CHARGES.

Computing Periodic FINANCE CHARGES: The FINANCE CHARGE is determined by multiplying the "Average Daily Balance" for purchases and for cash advances outstanding during the monthly billing cycle by the monthly "Periodic Rate." The monthly "Periodic Rate" for purchases is 1.575%, which is equivalent to an ANNUAL PERCENTAGE RATE of 18.9%. You may have the one-time Credit Limit Increase Fee refunded upon request within 30 days of billing, which will result in a reversal of the credit limit increase. ARBITRATION: If you are issued a credit card, your cardholder contract will contain a binding arbitration provision. In the event of any dispute relating to your credit card or cardholder contract, the dispute will be resolved by binding arbitration pursuant to the rules of the National Arbitration Forum and both you and we agree to waive the right to go to court or to have the dispute heard by a jury (except in regard to any collection activities on your account). You and we will be waiving any right to a jury trial and you also would not have the right to participate as part of a class of claimants relating to any dispute with us. Other rights available to you in court may also be unavailable in arbitration. YOUR BILLING RIGHTS: Keep this notice for future use. This notice contains important information about your rights and our responsibilities under the Fair Credit Billing Act.

Notify Us In Case Of Errors Or Questions About Your Statement. If you think your statement is wrong, or if you need more information about a transaction on your statement, write us on a separate sheet at the address listed on your statement. Write to us as soon as possible. We must hear from you no later than sixty (60) days after we send you the first Statement on which the error or problem appeared. You can telephone us, but doing so will not preserve your rights. In your letter, give us the following information: Your name and Credit Account Number; and the dollar amount of the suspected error. After we receive your letter, we cannot try to collect any amount you question, or report you as delinquent. We can continue to bill you for the amount you question, including FINANCE CHARGES, and we can apply any unpaid amount against your credit limit. If we find that we have made a mistake on your statement, you will not have to pay any FINANCE CHARGES related to any questioned amount. There are two limitations on this right: A) You must have made the purchase in your home state or, if not within your home state, within 100 miles of your current mailing address; and B) The purchase price must have been more than $50.00. These limitations do not apply if we own or operate the merchant, or if we mailed you the advertisement for the property or services.

Your Liability For Unauthorized Use Of Your Card. You will not be liable for unauthorized use of your Card. However, to protect your rights, you are required to notify us orally or in writing as soon as you are aware that your Card has been lost, stolen or used without your consent. After your enrollment form has been processed you will receive a personalized certificate explaining all benefits and provisions of the Payment Protection Plan. The effective date of coverage will be shown on your certificate.

All benefits are based on your account balance on the date of loss and do not include amounts (including insurance charges) added to your account after your loss. The monthly benefit payment will be calculated by multiplying your account balance on the date of loss by the minimum payment percent required by the creditor. The monthly benefit payment may not be enough to pay the required minimum monthly payment on your account balance.

Life and Disability Insurance benefits are payable up to the sum of your unpaid account balance at the time of loss or $5,000, whichever is less. Unemployment and Family Leave benefits are limited to 9 monthly benefit payments for each payable claim.

Life Insurance does not cover suicide during the first 6 months of coverage (This does not apply to residents of MD, MA, MS, and VT.) Disability Insurance does not cover losses caused by: normal pregnancy or childbirth; any intentionally self-inflicted injury; or a pre-existing medical condition. Family Leave Insurance covers unpaid absences from full-time employment while you or your Co-Insured are: caring for an immediate family member with a serious medical condition, caring for a newborn or adopted child for up to 3 months, on active military duty due to mandatory recall, on jury duty, or residing in a federally declared disaster area. Family Leave Insurance does not cover losses caused by a pre-existing medical condition. A pre-existing condition is one for which you saw or were under treatment by a physician or chiropractor both within the 6 months before and the 6 months after the effective date of coverage.

Plan Modifications

In AZ the insurance does not terminate; instead, the Life Insurance changes to Accidental Death Insurance at age 70. In CO, OR, PA, SC and TX, your plan includes only Life, Disability and Unemployment Insurance at a cost of 57.4 per $100 of your ending monthly balance (48.5 in CO, 57.2 in OR, 48 in PA; 44.9 in TX). In VT, your plan includes only Life, Disability and Family Leave Insurance at a cost of 40.9 per $100 of your ending monthly balance. In AL, CA, ME, NC, SD and VA, Family Leave benefits are limited to 6 monthly benefit payments (3 months for Family Leave in AK, CT, HI, MA and NH) for each payable claim. In MA, disability benefits begin on the 31st day following the date of loss. In MD, the Co-Insured must be your spouse. In NJ, you must be eligible to collect unemployment compensation benefits through the New Jersey Department of Labor to in able to receive Unemployment benefits. In NY, coverage is available to you, however, a special form is required. Call 1-800-445-6500. In PA, only the Primary Cardholder is covered for Life Insurance benefits. If you wish to purchase these coverages separately, call 1-800-445-6500. In TX, only you are covered for Life Insurance benefits at a cost of 44.9 per $100 of your ending monthly balance, and your coverage will not terminate. To be eligible for Unemployment coverage, you must be employed at least 30 hours per week in a non-seasonal occupation for at least 90 consecutive days prior to the effective date of coverage (self-employed Cardholders and independent contractors are not eligible for coverage). I was checking out another company through the rip off reports when I came across all of these complaints about First Premeir Bank. First I must say that alot of these complaints could have been avoided if people would read disclosures on their credit card agreements.

Let me also add here that many people probably dont read the disclosure for "good credit" credit card offers either.

In fact many people reading this dont realize that when they signed those credit card applications and accepted the card (first premeir or not)they have given that company the right to pull a copy of their credit reports anytime the company wants as often as the company wants, without notifying the cardholder. Duh people this is why even if you make all your payments on time but have been late on other accounts your interest rates go up.

Also when you accept most credit cards you are accepting to abide by the "arbitration agreemnt" contained in the disclosures. Which states typically that you will not take part in CLASS ACTION suit against that card company and that you waive your right to a jury trial.

First Premeir is not the only credit card company that has very high fees associated with approval of an account. Many second chance banks offer similiar programs to help people rebuild their credit. Now I will admit that their are certain complaints in here that are valid (fees for returned payments that were never authorized to begin with etc) I have two more things to say before I'm done. (1) We as citizens in the US owe over 5.2 trillion dollars in consumer debt (credit cards and signature loans) with bankruptcy laws changing and more that 21% of cardholders defaulting on their accounts. The number of people who need a second chance is going to increase. (2) Banks are in business to make money. They raise interest rates to make people default on their accounts. This way the bank collects insurance money, gets a tax deduction of $2 dollars for every $1 that you default on. then turns around and sells your debt to collections for 25-35 cents on the dollar. Remember this BANKS NEVER LOOSE MONEY ON A CREDIT CARD ACCOUNT

Account Terms: This credit card account ("Account") is offered and credit cards are issued by First PREMIER Bank (Sioux Falls, SD). When your application is approved, the complete terms applicable to the Account will be furnished to you with the card. In the following disclosures, "Bank," "we," "our," and "us" refer to First PREMIER Bank, and "you" and "your" each refer to the person applying to us for an Account.

Available Credit: The Account Set-Up Fee of $29.00, the Program Fee of $95.00, the Annual Fee of $48.00, the Additional Card Fee of $20.00 (if applicable), and monthly Participation Fee of $6.95 will appear on your first billing statement. These fees will reduce your available credit until they are paid. If you are assigned the minimum credit limit of $250 your initial available credit will be $71.05 ($51.05 if you select the additional card option). FINANCE CHARGES: Your Account will also be subject to the following FINANCE CHARGES, each of which will be billed to your Account as a purchase:

Periodic FINANCE CHARGES: FINANCE CHARGES are imposed when you obtain a cash advance and when a purchase is posted to your Account. FINANCE CHARGES are imposed from the time a purchase is posted until it is paid in full. However, if you pay your previous balance in full on or before the payment due date shown on your previous statement, you will have a grace period on purchases of twenty-five (25) days (from the statement closing date to the payment due date) and can avoid FINANCE CHARGES on current purchases by paying the current statement in full on or before that payment due date. FINANCE CHARGES are imposed on cash advances from the date the advance is made until it is paid in full and there is no grace period in which you may repay a cash advance to avoid FINANCE CHARGES.

Computing Periodic FINANCE CHARGES: The FINANCE CHARGE is determined by multiplying the "Average Daily Balance" for purchases and for cash advances outstanding during the monthly billing cycle by the monthly "Periodic Rate." The monthly "Periodic Rate" for purchases is 1.575%, which is equivalent to an ANNUAL PERCENTAGE RATE of 18.9%. The monthly "Periodic Rate" for cash advances is 1.575%, which is equivalent to an ANNUAL PERCENTAGE RATE of 18.9%. The "Average Daily Balance" is computed by taking the beginning balance of your Account on each day, calculated separately for purchases and cash advances, adding new purchases and/or cash advances and subtracting any payments or credits to get each day's daily balance. Program Fee: We impose a one-time Program Fee of $95.00. This fee allows us to issue an unsecured card to consumers who may not be eligible for other unsecured credit. The Program Fee is a FINANCE CHARGE.

Internet Access Fee: We impose a fee of $3.95 for Internet Access to your account. This is a one-time fee, which will only be assessed after you have agreed to this service. This fee is a FINANCE CHARGE.

Authorization: You certify that all information given in this application is true and correct and you are giving this information in order to obtain credit and authorize First PREMIER Bank ("Bank") to obtain information concerning any statements herein. You agree to furnish the Bank with all requested information. If you elect to close your Account(s) within 30 days of receiving your cardholder contract and before you make any additional charges to the card, the Annual Fee, Account Set-Up Fee, Program Fee, monthly Participation Fee and Additional Card Fee (if applicable) will be refunded to you. You may have the one-time Credit Limit Increase Fee refunded upon request within 30 days of billing, which will result in a reversal of the credit limit increase. After this 30-day period these fees are no longer refundable and you are responsible for the account.

ARBITRATION: If you are issued a credit card, your cardholder contract will contain a binding arbitration provision. In the event of any dispute relating to your credit card or cardholder contract, the dispute will be resolved by binding arbitration pursuant to the rules of the National Arbitration Forum and both you and we agree to waive the right to go to court or to have the dispute heard by a jury (except in regard to any collection activities on your account). You and we will be waiving any right to a jury trial and you also would not have the right to participate as part of a class of claimants relating to any dispute with us. Other rights available to you in court may also be unavailable in arbitration. When you receive your cardholder contract you should read the arbitration provision in your contract carefully and not accept or use the card unless you agree to be bound by the arbitration provision.



YOUR BILLING RIGHTS: Keep this notice for future use. This notice contains important information about your rights and our responsibilities under the Fair Credit Billing Act.

Notify Us In Case Of Errors Or Questions About Your Statement. If you think your statement is wrong, or if you need more information about a transaction on your statement, write us on a separate sheet at the address listed on your statement. Write to us as soon as possible. We must hear from you no later than sixty (60) days after we send you the first Statement on which the error or problem appeared. You can telephone us, but doing so will not preserve your rights. In your letter, give us the following information: Your name and Credit Account Number; and the dollar amount of the suspected error. Describe the error and explain, if you can, why you believe there is an error. If you need more information, describe the item you are not sure about. If you have authorized us to pay your credit card bill automatically from your savings or checking account, you can stop payment on any amount you think is wrong. To stop the payment, your letter must reach us three (3) business days before the automatic payment is scheduled to occur.

Your Rights And Our Responsibilities After We Receive Your Written Notice. We must acknowledge your letter within thirty (30) days, unless we have corrected the error by then. Within ninety (90) days, we must either correct the error or explain why we believe the statement was correct. After we receive your letter, we cannot try to collect any amount you question, or report you as delinquent. We can continue to bill you for the amount you question, including FINANCE CHARGES, and we can apply any unpaid amount against your credit limit. You do not have to pay any questioned amount while we are investigating, but you are still obligated to pay the parts of your statement that are not in question. If we find that we have made a mistake on your statement, you will not have to pay any FINANCE CHARGES related to any questioned amount. If we didn't make a mistake, you may have to pay FINANCE CHARGES and you will have to make up any missed payments on the questioned amount. In either case, we will send you a statement of the amount you owe and the date that it is due. If you fail to pay the amount that we think you owe, we may report you as delinquent. However, if our explanation does not satisfy you and you write us within ten (10) days telling us that you still refuse to pay, we must tell anyone we report you to that you have a question about your statement. And, we must tell you the name of anyone we reported you to. We must tell anyone we report you to that the matter has been settled between us when it finally is. If we do not follow these rules, we cannot collect the first $50.00 of the questioned amount, even if your statement was correct.

Special Rules Regarding Credit Card Purchases. If you have a problem with the quality of property or services that you purchased with a credit card, and you have tried in good faith to correct the problem with the merchant, you may have the right not to pay the remaining amount due on the property or services. There are two limitations on this right: A) You must have made the purchase in your home state or, if not within your home state, within 100 miles of your current mailing address; and B) The purchase price must have been more than $50.00. These limitations do not apply if we own or operate the merchant, or if we mailed you the advertisement for the property or services.

Your Liability For Unauthorized Use Of Your Card. You will not be liable for unauthorized use of your Card. However, to protect your rights, you are required to notify us orally or in writing as soon as you are aware that your Card has been lost, stolen or used without your consent. Certain exceptions apply and you may be liable for up to $50.00.

Information Sharing: The following describes your agreement with us with respect to information sharing. By requesting, obtaining, or using a credit card from us you agree that we may release information in our records regarding you and your Account: to comply with any properly served subpoena or similar request issued by a state or federal agency or court; to share your credit performance with credit reporting agencies and other creditors who we reasonably believe are or may be doing business with you on your Account; to provide information on your Account to any third party who we believe is conducting an inquiry in accordance with the Federal Fair Credit Reporting Act; to share information with our employees, agents or representatives performing work for the Bank in connection with your Account; or to communicate information as to our transactions or experiences with you to persons or entities related by common ownership or affiliated by the corporate control or with any third party (including non-affiliates). We may also share information such as (1) information other than our own transactions with you with persons or entities related to the Bank by common ownership or corporate control or (2) information on your Account with certain companies to provide or offer you selected products, services, or cardholder benefits. California Residents: A married applicant may apply for a separate account. As required by law, you are hereby notified that a negative credit reporting reflecting on your credit record may be submitted to a credit reporting agency if you fail to fulfill the terms of your credit obligations. Each applicant may be liable for amounts extended under the plan to any joint applicant. Delaware Residents: Service charges not in excess of those permitted by law will be charged on the outstanding balances from month to month. Payment Protection Plan:

During the months when you have a credit card balance, the monthly cost for this coverage is 75 per $100 of your ending monthly balance. This charge is automatically included on your billing statement each month. Of course, during months when you have no balance, there is no charge. In AL, CA, ME, NC, SD and VA, Family Leave benefits are limited to 6 monthly benefit payments (3 months for Family Leave in AK, CT, HI, MA and NH) for each payable claim. In MA, disability benefits begin on the 31st day following the date of loss. In MD, the Co-Insured must be your spouse. In NJ, you must be eligible to collect unemployment compensation benefits through the New Jersey Department of Labor to in able to receive Unemployment benefits. In NY, coverage is available to you, however, a special form is required. Call 1-800-445-6500. In PA, only the Primary Cardholder is covered for Life Insurance benefits. If you wish to purchase these coverages separately, call 1-800-445-6500. In TX, only you are covered for Life Insurance benefits at a cost of 44.9 per $100 of your ending monthly balance, and your coverage will not terminate. To be eligible for Unemployment coverage, you must be employed at least 30 hours per week in a non-seasonal occupation for at least 90 consecutive days prior to the effective date of coverage (self-employed Cardholders and independent contractors are not eligible for coverage). Unemployment coverage excludes retirement, resignation, job loss due to willful or criminal misconduct and disability. The 9 month limit on Unemployment benefits does not apply. If you wish to limit your coverage to Life and Disability only at a cost of 23 per $100 of your ending monthly balance, call 1-800-445-6500. In AL, and CO , to be eligible for this insurance, you must be employed at least 30 hours per week on the date you enroll.

This insurance charge will be shown on your credit card account statement and included in your new balance. We can change the rate later on. But, if we do, we will let you know in advance. The new rate will apply only to charges for insurance made after the date of the rate change. 4.Your Co-Insured is not eligible for Disability or Involuntary Unemployment Insurance. 5. Neither you nor your Co-Insured are eligible for insurance after you have reached your 71st birthday. Insurance for the Co-Insured stops on his or her 71st birthday if he or she reaches age 71 before you do. Otherwise, all insurance stops on the first billing date after you reach age 71.

Please show me in the disclosures my husband received where there is a $3.95 internet access fee on a paid off credit card. Also, there WAS no disclosure to such when he received the cards, nor was any disclosure ever received at a later date. No, we didn't get it and throw it out. With my background and training, I must be detail oriented, hence, I am a big fan of the concept of DOCUMENTATION.



Oh, and we ran his credit report again this morning and ALL of his cards with First Premier are showing "PAID IN FULL" AND ZERO BALANCE. So, why are we still getting bills, overlimit fees, etc on PAID OFF accounts?



Additionally, company shill, my husband will be flying to Pierre, South Dakota next Monday for a meeting. Give you three guesses who the meeting is with.
