I would like to let you know that you should not be accusing GEICO of anything. It is not GEICOs fault this person who was previously insured with them either cancelled or didnt pay their bill. What you should do is go through your insurance and see how they can help you. As far as this goes. You would carry partial negligence in this accident for overreacting so you should be thankful that person in not insured or you would be in real trouble.

GEICO can not help that this customer had left the comany. I had a situation where the lady gave fasle identification and false insurance card.The police could not track her down. That is why I carry insurance so that if this happens my car is repaired. Sounds like you did not. GEICO did nothing wrong. Why are you mad at them and not YOUR insurance company?

He didnt have Allstate either, you should report a rip off report for them too. and every other insurance company that he didn't pay for coverage.

Were there stop signs or was this a straight road? Why not slow down to let them get far enough ahead of you to avoid this. I'm assuming that is you were doing the speed limit and this still totalled both cars, then you were on the highway. Where did you turn to to avoid this that they could turn also? Sounds to me like you have road rage and you need to control yourself.

While I understand your situation is frustrating, GEICO is not liable for fraud. I am trying to figure out how GEICO told you that he did not have insurance and then told you that he did have insurance (March date you mentioned). There are certain steps that GEICO goes through to determine if there is coverage for a particular claim. It actually has to be agreed upon by three people in office, the adjuster, the adjuster's supervisor, and an administrator. Only then can coverage be denied. If that is the case and liability is clear on the police report and he does have insurance through them, then you could possibly recover from his insurance. However, if he does not have insurance through GEICO, GEICO is not obligated to cover for your loss just because someone else is being fraudulent.

I was a former adjuster for GEICO. Their practices are the same as any other insurance company. They have no obligation to a third party (yourself). Their only obligation is to pay for what their policyholders are legally liable for per the policy contract (which for the most part is mandated by state statutes). And only then are they responsible for pay a third party what is reasonable and necessary If the tortfeasor in this accident was not insured with GEICO, then there can be no recovery from a company he just mentioned he had insurance through.

On a side note, Not wearing a seatbelt has nothing to do with the tort caused by the other driver regardless if he was ticketed or not. I find it hard to believe that if you are caught without insurance that you are arrested on the spot. In most cases, you are given only a citation for it and a chance to rebuttle the citation if you can provide proof of insurance within 30 days.

If you have first party coverages such as medpay or pip, you can use that for your medical bills. Also, if you have collision insurance, I would use that to get your car fixed and then have your insurance company go after this guy for you. If he doesn't have insurance, he would be responsible for paying out of pocket to reimburse your insurance company. At GEICO, we would set people that were the tortfeasor of an accident on a payment plan to recover their costs. Otherwise, the insurance company can file suit if there is clear liability to a claim and the insurance company wants their money back.

I handle claims in Florida so I am not all that familiar with Georgia state law. However, insurance policies are 6 month contracts that required an initial deposit of 2 months (at least in Fl). So lets say you either start a new policy or your current policy just renewed and you have a set of "valid" policy id cards that reflect 3/08 - 9/08. You did not feel the need to make your monthly payment to GEICO in May so your policy canceled. You STILL have your "VALID" policy cards right? you show these to the officer and he takes them for what they reflect. The person you just hit calls GEICO to make a claim and we advise them that it appears that your policy was not in force at the time of the accident. Did GEICO defraud them? Its not our fault that someone doesnt keep their policy paid up to date.

Oh, one other thing. Its not Geico, inc. its GEICO (Government Employees Insurance Company).

I am so sorry for the trouble you are going through. Unfortunately, in Georgia ID cards are not valid insurance cards. GA has a database that insurance companies report to. The GSP should have checked this when reporting to the accident. The previous posts are correct though. Report this to your insurance and they should pay out under you uninsured bodily injury and property damage. I hope this helps. Good Luck!

Then Geico didn't rip you off. You should be going after the driver himself and his new insurance company (if any).

For a long time I had Allstate for my auto insurance company. A little over three months ago I switched to Progressive. If I were in a car accident, Allstate is under no obligation to pay for damages and they would not be ripping anyone off for refusing to do so.

Don't YOU have insurance? Go thru them and let them deal with geico. I carry uninsured motorist coverage just for cases like that. And what is with every word being capitalized? You stated that the other driver kept "turning in front of me" what was he doing , making circles in the road? I don't think YOU know how to drive all that safely either or for one thing you would not have hit him so hard. How fast were you going? I'll bet YOU were not paying that close attention yourself.
