GMAC Homecoming Financial ILLEGAL COLLECTIONS AND FORCLOSURE ATTEMPTS... ACCESSIVE FEES.. BEWARE!!!! Louiville Kentucky

I obtained a mortgage with homecomings in April 2002. I was always on time with my payments. My 10 year old daughter became ill and I lost my job in 2006. I fell behind in my payments in 2007 for 2500. I had to file bankruptcy. I filed bankruptcy to keep my home. while in bankruptcy I was making payments through my trustee of over 4900. which they were advising the court that they were not receiving my payments.

Which they were and we had a print out of they receiving them from my trustee and I also went on line to their website and printed off my statements showing they received all of them. While in my bankruptcy, the only thing that I wanted to keep was my home. My attorney and their attorney agreed that once my bankruptcy was discharged, homecomings would set me up on a payment plan for my back payments.

Which should only total approximately 2400. After my bankruptcy was discharged I immediately received a letter from the bankruptcy court that homecomings was requesting a stay lifted so they could begin forclosure proceedings. My attorney immediately contacted their attorney and said, hey we had an agreement that you were going to work with my client. They immediately withdrew their motion and I was under the impression that everything would be taken care of.

It took until Oct 2007 for everything with my bankruptcy to be completed and release so that I could work directly with them to make arrangements. November 07 was the last payment I sent to them directly. I again received another notice of default from another department that advised me to call to make arrangements which I did. I spoke to them the end of Nov 07, signed and faxed a release from my attorney for them to work directly with me.

I also was instructed to go on line to their website to download a financial worksheet, which I filled out, i also sent them my income and also my letter requesting my modification. I called to verify they received this info in Dec 07 and was advised yes, they received it and it was being processed, they advised me that it could take up to 3 months due to the amount of repayment and modification's requested. I specifically asked, what do I do in the mean time?

Do I keep sending my reg payments, each rep advised me not to send any payments while this was being done that if I send payments they will be returned to me. So I just started depositing my payments in the bank. A month went by and I heard nothing. I called and was advised several times, dont worry it takes this long, just waiting they will contact you once its complete. another 3 weeks went by and still nothing.

Everytime I contacted them they would tell me the same thing. Until Feb 08, I started calling them every week and soon every other day. finally last week when I called I was advised that my modification was denied, they couldnt tell me why and I request a supervisor and they will never transfer you. They advised they put in a request for someone to contact me within 48 hours. I never received a call, when I called back they advised me that it would be within 48 hours, it within 14 days.

In the mean time 3 days ago I received a collection notice from an attorney advising me that I owe the entire 53000 on my mortgage and when I called the company they are advising me now I am in forclosure. I never even received a default letter or a forclosure notice. I have called 3-4 times a day for the last 3 days and had to hold on the phone at least 1 1/2 hours to speak to someone who will tell me nothing.

I finally spoke to a rep that said she was going to try to get a repayment plan approved for me, (this was 2 days ago), she again took my income and expenses, asked me what I could put as a downpayment to start the repayment plan. I advised her I could go and pay 1500.00 right now through money gram or over the phone. The rep said okay, im going to call you back myself once this is approved and get this set up, because if we try to do a modification it will take at least 30 days.

I have yet to receive a call from her or anyone else from their company. I dont know what to do. I contacted my bankruptcy attorney and he was absolutely no help. What do I do,OOOOOHHHH....not to mention the fact that they charged me an addition 4110 in fees while i was in bankruptcy and will not tell me what they are for. Just says fees on my print out and they money that I sent in for my payments went to pay this fee off!!! THEY ARE CROOKS........I NEED HELP, CANT LOOSE MY HOME, THAT IS THE REASON I FILED BANKRUPTCY WAS TO KEEP IT!!! I KNOW THIS CANNOT BE LEGAL!! HELP!!
