WE have just see a newspaper article in the irish times warning the public about rogue holiday operators. The office of the director of consumer affairs in ireland said people receiving unsolicitated phone calls from american company offering free or special offer holidays. She said the companies knew the name and address of consumers. Seems as if they offering a genuine prize of cruise that had been won.

We just started searching the internet and saw the reports of this company. Last year in April 2004 we received a telephone call from Imperial majesty cruise vactions to say we won a holiday and then we ended up paying USD898 to imperial majesty Cruise vactions in florida for a holiday 1 week with an option of a 2 night cruise and i week in fort lauderdale.

Yesterday we phoned and booked to go on September 2005. Today we saw the article in the newspaper. Can someone advise what steps we take now to try and reclaim our money.

Over a year ago I fell for this hard sell. Over 800 Euro had been charged to my Credit Card by the time the call finished. I cancelled with Visa immediately but they didn't help. Fortunately, I was advised by the Office of Consumer Affairs in Dublin and, as a result, obtained a full refund nine months after the transaction. Incredibly, IMCV phoned me again a month ago with the same persuasive technique - a survey this time. Once bitten, twice shy! I will copy below this my original post to BBB so anyone who reads this can get a refund - as I did. No reputable company would resort to this type of selling. Anyone who doubts this should trawl through earlier posts and read of the experiences of people who did go on this "holiday". The good news is that my Credit Card was credited with the full amount 7-10 days after posting the letter. Good luck to everyone and thanks again to BadBusinessBureau.

2419 East Commercial Boulevard, Fort Lauderdale, Florida 33308-4042.

Mark the letter for the attention of: Mr Daniel Lambert and Ms Gena Johns. Fax the letter as well as posting it. You will find their Fax No. if you search this site. (*see below)

In the letter just state the facts without threats.

Inform them that the holiday they sold you was misrepresented by their company or its agents. You should also state that under Distance Selling Legislation there is a "cooling off period" of seven days and that you cancelled within that period. Say this whether you did or not. Then write:

"This letter is a formal Demand Letter for relief relating to Ramada Plaza Resorts' wilful, unfair and deceptive marketing practices.

"You are in violation of the Fair Business Practice Act. You are also in violation of the United States Postal Services Mail Fraud Laws as you have used these services to further your scheme"

You should end by writing that if they do not refund the amount taken from your account, you will communicate the matter to the Attorney General's Office and to Mr Charles Bronson, Florida Dept. of Agriculture & Consumer Services.
*I have located two Fax Nos. (954)567-9339 and (954)568-3847. One of them seemed to be non-functional.
