We had the same experience as Linda but she was the smart one and was able to walk away. We were suckered by the hard sell and took the bait. That night we discussed what we had done and realized it was a big mistake. The next morning my husband went to Kis Golf at Concord Mills to cancel the sale.
The store manager said it was to late to cancel. He said the golf clubs had been ordered and made. My husband asked him how could the golf clubs have been made in less than 16 hours. Manager said they started the order as soon as we left that previous afternoon at 4:30. He told the manager we would be glad to pay for the clubs but were not willing to join the club. The manager said the two set of clubs were $8475.00 because the were made special for us.
We contacted the corporate office and the Concord location numerous times and were told we would not receive a refund nor be released from the contract. They were arrogant, and I mean arrogant. They knew we were locked into the credit card company and they didn't care because they had received their money. Kis Golf told us we could take advantage of this great deal or sit on our sofa and watch t.v..
We contacted an attorney to help us and after several attempts to settle this terrible situation he wasn't any further with them than we had gotten. Our only solution was court and which a judgement was taken against Kis Golf.
At this time we and our attorney are waiting to be reimbursed our money. We had to pay the credit card or our credit would have been ruined.
Please do not do any business with Kis Golf and Country Club. They are a bunch of snakes waiting to strike.

They are still Kis people. George McGill puts the company in friends names and starts over. He's filed bankruptcy over 4 dozen times in 20 years.

Which location did you work at i was a member at the kis golf in Kennesaw Ga. A friend and fellow member went by the store there and talked to the owner of that location who stated he and his employess were unaware that this was going to happen. He state that was out of close to 150,000 and was going to attempt to keep the store and change the name if the main company doesnt help. not sure how that would work out. I just wont out!!!

Hey Mitchell, where are you NOW??

Well golly Mitchell, look who has on eggs on his face. That would be you. Way to go on defending this company and good luck with your lifetime golf membership. I will be waiting for your oh so insightful quip as a response. Or I may make the prediction that I will in fact never read any of your stupid responses on here again because you are a sheep. Big business looks out for big business. Watch the news my friend. Remember our little conversation about the morality of driving SUVs? Guess which car companies are on the brink of bankruptcy!? The ones that build your favorite model. And guess which executives drive SUVs? You guessed it! The top execs at KIS Golf. The same ones who have no moral compass. The same ones who were still selling "memberships" hours before getting kicked out of their mall locations for not paying rent.
To any one who may read this. Find all my posts and you will read that I have been spot on about this scam from the moment they called me. Thank you Jesus for RIPOFF REPORT!!!

ps.and to my friend pondering contract law; who is going to hold KIS Golf to the fire concerning their breach of contract to all their members? Contracts do not seem to be worth the paper they are printed on.

In the Carolinas the only 2 ways out of a contract are real estate recissionary periods and in home door to door sales
Sure wish the OP would say what finally happened

Not so wrong, friend

There is a question concerning the timetable and method of your attempted withdrawal from your contract. Did you send your cancellation in writing or did you just call or visit the store?
Most states have laws that allow you to cancel written contracts covering the purchase of certain goods or services within a few days of signing. Many states have laws that allow you to cancel contracts for health club memberships, dating services, weight loss programs, dance or martial arts lessons, time share properties, hearing aids, etc. Call your state consumer protection agency to find out what contracts, if any, are covered in your state. This information may be too late, and certainly not the type of information that KIS Golf wants consumers to know about.
In general, you may cancel within three days of signing a contract, but it must be mailed before midnight of the third day. However, it seems that if you called the store the next day, they had the option to accept your withdrawal over the phone. So, I do not think that I am "so wrong." It depends on your state.
I think that is the issue.
KIS Golf could just void the contract if someone notifies them the next day, (legal or not legal) but that would make the hard sales tactics worthless.
The majority of the complaints about KIS is the hard sell and these weird contracts. If they would just sell clubs, they would not need a contract. Instead they bundle in these lessons like it is a membership. If I wanted to join a golf club, I wouldn't go to a mall.
But I could be wrong.

So Wrong

"In the U.S. you are in fact allowed to back out of a signed contract within three working days. It varies from state to state. You see Mitchell, this is why KIS Golf lost in court."
Three day right of recission only applies to real estate, not cars, or memberships etc etc.
Why has the OP not replied with an update to there court visit? Probably was appealled and lost.
I am not associated with this company or anything to do with golf.

Mitchell fights for the "Man" once again
AUTHOR: Chris R - (U.S.A.)
SUBMITTED: Saturday, November 01, 2008
Once again Mitchell,
In the U.S. you are in fact allowed to back out of a signed contract within three working days. It varies from state to state. You see Mitchell, this is why KIS Golf lost in court.
Do you own a house Mitchell? In your paperwork, their should have been a clause concerning your right to in fact cancel the terms of the contract within three days of closing. This is why your finance officer does not send in payment until three days after closing.
So let me ask you, Mitchell, why is it perfectly legal to back out of a contract for $200,000.00, but not $8475.00?
"To file a complaint based on the fact that you are blaming someone else for not letting you out of a contract that you signed. Thats just ridiculous."
Once again Mitchell, you have failed to see the ethical grounds, and, in this case, legal grounds that most people understand when signing binding contracts. It seems like only you and KIS Golf just don't get it. Maybe the two of you are blinded by money. I would say greed, but that is a sin. Ridiculous.
The issue is simple: if KIS Golf wants to sell a product, then allow people to purchase the product with their own finances. Why does KIS not allow for this? They are pulling people's credit, (which messes with their score by the way), opening a new line of credit, (at what rate I have no idea), and letting them walk out without having to spend a dime. Wow, a ZERO down loan. What a horrible idea. That KIS does this over and over should show you that they are fleecing their "customers." When the customer realizes how they just got taken, they do what everyone has the right to do. There is no such thing as "all sales are final." This is why KIS opens a new line of credit, because if you simply purchase this product on your own credit card, you can dispute the charges. Another red flag is that there seems to be no set price on this "product" KIS Golf is selling. The price seems to be determined on how large or small the new line of credit is for each individual. Ridiculous.
Mitchell, do you know what a credit score is? Do you know yours? I know mine. It is averaged out between the three major sources to be in the 800s. Do you understand that people rely on their credit score to get loans, to get decent rates, to get jobs, etc? Why would anyone allow their credit score to be harmed? Ridiculous.
What I am most interested in is your motivation to defend KIS Golf. ?? Why do you fight for the over-dog? Why would you refer to someone's legal right to annul a contract as being "ridiculous?" Who are they to blame for not letting them out of this contract? Who do you think they should blame? Themselves? What is it about money that makes a business think they can operate under a different set of rules and regulations?
Why do you not admit that you have a vested interest in KIS Golf? Ridiculous.
Please respond with more nonsense concerning your distorted view of ethical and legal behavior.
Your friend and mentor,
CR
