This is a addition to a report I read about Kmart and Why not Lease. So we had moved to Utah in June of 2016. In July of 2016 we walked into a Kmart to look at some merchandise. It was in the evening about 8pm. I was surprised that the store was completely vacant except for maybe one customer in the whole store. (The new Walmart next to the Kmart was packed). Anyways, we needed a new bed in one of the bedroom s of our new home. And I walk by some Thempupurdic mattress and see that their a little over $200. At the time we couldn't afford it. But, while we are paying for our merchandise we notice that Kmart has a layaway program. Or at least we were led to believe it was a layaway program by the employees. And also by the advertising of Kmart. Well read the fine print on your paperwork people. Cause we didn't. It's not a layaway program. Quite simply, it's a lease with the option to buy. At full price!!!! After 11 months of paying for this lease. My wife says. "Can you check on this layaway from Kmart, their still pulling $70 from my account." So I call this company, Why not Lease. And they tell me that we've been leasing this mattress. And we can get out of our lease by buying the mattress at full price. Or continue leasing. Or return the merchandise. So to return the merchandise you can't take it to your "local" Kmart. I would have to drive it or ship it to New Hampshire.

Bottom line. The Lay away program advertised by Kmart is disinformation. It's not a Lay a way at all. It's a Lease. Read your paperwork. And avoid having merchandise or service s automatically pulled from your account. Shame on Kmart for false advertising that you can purchase items on a Lay away program. A lie is a lie no matter how you look at it. And quite frankly, we were lied to.

Where?

AUTHOR: Robert - (USA)

POSTED: Thursday, May 04, 2017

Where was this "Miss" information?

The program is called "Why not Lease". It has LEASE in the name, what did you think that meant?

I couldn't find a single thing from this that called it a Layaway except for what you are claiming.  Unless I am mistaken a "Layaway" program is one where they set aside an item and you make payments over a given time. Once you have made those payments they let take the merchandise. They do have a Layaway program but why would you think that this was a "Layaway" program if you actually received the items without paying in full?

The terms you posted state the "LEASE" terms with 3 options. To continue paying as you have been(no mention of any end date), To buy the item outright per the terms, or return the item.

So what exactly did they misrepresent?
