I am a loyal, paying member of LA Fitness. I do love the floor weights and exercises, but swimming is my main avenue for exercise, as I have some physical limitations that are best addressed by swimming. I made this fact known when I signed up with LA Fitness at 5591 Sheridan Street, Hollywood, Florida. They assured me that the swimming lanes were available most of the time. The lanes were rarely available, so I inquired about my membership transfer to LA Fitness at 350 N. University Drive, Pembroke Pines, Florida. It was transferable and I began swimming at least 3 times a week at the pool in Pembroke Pines. I usually arrived anywhere from 11:00am - 2:00pm.
After about 3 months, my swimming became very limited and I was forced out of the pool on at least 8 occasions, while the pool maintenance sprayed cleansing foam into the pool while I was swimming and also wrapped a large electrical hose that fed the cleaner across the pool, blocking my swimming.
I asked management when the pool maintenance was scheduled so that I would not interfere with their cleaning. They told me around 1:00pm. I came the next days earlier and I was still chased out of the pool. I this time asked management if there was a schedule for cleaning and he told me Tuesdays and Thursdays around lunch time. I came on M-W-F and the maintenance chased me out of the pool.
This went on for about 1 month. I asked to speak to someone and told them that I was losing money by dressing to swim and being chased away. They explained to me that they cannot dictate to pool maintenance what time they should clean. I explained that I wanted money back for the month and they said it was not their responsibility to provide swim time to the members.
At the risk of being further forward, I must say that the women's bathrooms and showers are always filthy, with toilet paper, hair and such in the showers and all over the floor. I had asked nicely one day if someone could clean at least one of the showers so that I could shower. The staff told me that they would have it taken care of. One hour later, when I went to the shower, there was still no shower available that was sanitary.
I'm not expecting that all of the facility be up and running, and perhaps this particular LA Fitness is going bankrupt, since the whirlpool and steam rooms were not working for one month. The staff kept saying that the parts were "on order". If this facility is going bankrupt, I suppose I will never recover my lost fees but will file a Class Action Lawsuit.
I do not want to discontinue my membership with this location but, instead, want one month's membership fees reimbursed and a solid explanation of when I can free swim without being chased away or interfered with by the pool cleaning/maintenance

I am not LA Fitness. I am Flynrider. It says that clearly on my post. I'm not sure why you would think I was LA Fitness, as my post recommended you take them to court. Does that sound like something that I would say if I were LA Fitness? Common sense should tell you it is not.
Also, I am not mocking your class action suit. I am mocking you. If your husband is really a lawyer he should have explained to you what a class action suit is. Obviously, that has not happened.
Also, if he really is a lawyer he would likely agree with my original post recommending the proper venue for this type of complaint. I know it doesn't sound as classy, but it's really the most appropriate and cost effective way of getting your case heard.
Lastly, if your delusion that I am actually LA Fitness continues, then I'd like to inform you that you can swim uninterrupted between 2:17 AM and 2:33 AM on alternating Wednesdays and Sundays.

LA Fitness has responded to my highly-detailed, well-documented complaint about unsanitary conditions, unavailable pool time, broken equipment by telling me that I really don't know what is a Class Action Lawsuit and that I don't have enough proof to follow up.
That just makes the challenge more appealing to obtain justice.
All I want, really, is to know when the pool will be available so that I can get my money's worth of membership. It's really simple. They are unwilling to do this. I have the names of other members who were chased out of the pool and I will start to gather more documentation. I also have names of members who could not use the wet spa or jacuzzi for months at a time.
It is sad that LA Fitness thinks that it is such a huge conglomerate that the members have no rights - pretending to be "Wall Street" and mocking the members' opinions.
Again, I could ignore the unsanitary conditions in the bathroom (I DID take photos) and the broken steam room and jacuzzi. I just simply wanted to swim laps for my health. I just want to swim. How can it get any simpler than that?
Well, I'm really sorry that this small request cannot be met. Blogs are free and I have freedom of speech and will start there.
Since my husband is a Civil Rights attorney, we will start the suit. I already have Constant Contact set up to start the ball rolling. I really don't want to do this, but I REALLY need to swim for my health.
LA Fitness has 2 weeks to provide a written statement to me of the times that I may swim laps in the pool. I'm marking it on the calendar now.
I will not cancel my membership and give up.

Be honest. You really have no idea what a class action lawsuit is, do you? I have a feeling that people invoke the "class action" threat because they think it sounds classier than a regular lawsuit :-))
I'll give you a hint on this one. Do you know of a large number people who claim to have been regularly chased out of the pool by maintenance? Would it be uneconomical for you to take action on this on your own? The answer to both is likely "no", which means you should just file in the less classy small claims court and be done with it. If you can prove that you've been continually chased out of the pool, you should get what you want.
