Merchant One Tried to cancel and told there was a 3 year contract and $295 fee to cancel Internet, Internet

When I setup an account with Merchant One it was with the understanding that there
were no early termination fee. I know I asked the sales person because I wanted
to just try them out and was weary using an online business. I did not want to
get stuck using a product we were not able to utilize with our website.

I also asked if there were any other fees other than what he mentioned and he stated that there were not. They sent me an electronic version of their application of where it states.

The Agreement contains a provision that in the event you terminate the Agreement
early, you will be responsible for the payment of an early termination fee as set forth in Section 37 and in Section 9 of this Application under "Service Fee Schedule."

Within this application there is no section 37 nor does section 9 cover any type of
early termination fee. Upon reading this, since I already established that were
was not an early fee to terminate, I did not have a reason to question this
further.

After discussing this discrepancy with a manager John at Merchant One, a few days
ago, when trying to cancel my account with them, I was told that the early
termination fee is explained in the program guide under Section 37.

The fact that they never mention that program guide in terms of the early termination fee prior or on their application is very suspect. Not only that, but I found out the following December that there is also a $99 a year fee that is applied, of which the sales person never informed me of, even after asking him if there were any other fees.  

Now seeing that this company now has over 180 complaints on BBB.org, I wish I would have looked into them first. I also called Merchant One to look into setting up an
account a few days ago to say what they would say about cancelling and was told
that there was no early termination fee.

When I mentioned this to John he stated that it's a spring time special they are
running now. I find that very suspicious as well.
