I have a letter to pick up from the Court system here in Columbus that was sent to me certified but I just happened to not live at the address they sent it to. A freind let me know something from the court was sent to me and I needed to go pick it up. So I took the time to jump on the county web site and seen that an attorney (BABIK, STEPHAN P) has sent a summons to me in regards to a (COMPLAINT FOR CONTRACTS/NOTES/ACCOUNTS) From Midland funding llc. Not knowing what this was or ever hearing of the company I searched on the internet and found This sight and seen all this stuff on Midland funding and now I know its a bogus ordeal. I want to know what actions I need to take and if I should go pick up this summons and reply to it and since they seem to make money off of the weak I want to reverse this and make money off them. This is not right and I want to get them for screwing other people such as my self. Please advise on what exactly I need to do......

collection agency and the lawyers that sue for these low lifes read this site.

right now all that's going to happen is you'll get a default judgement, if the summons was served at you old address, you could get it vacated, but if there is only a slip telling you a certified letter is waiting for you, you still haven't been served.

collection agencies do make it some what easy to file counterclaims againt them, but read 15 usc 1691(k)(c), you have to prove the violations were intentional.

sol in ohio are 15 years on a written contract and I believe 6 on a open contract.

15 years is a long time to remember, all the debts you ever had, since after 7 years, they fall off credit reports, so this may very well not be a bogus claim. and almost every attorney tires to file all claims under written contracts.

If a default judgement is entered, once you have it vacated, your still going to have to deal with it, it will just be served to you, within a week.

you should take this time to read ohio civil rules 10,11,12,26,33,34 and 36 all of these will come into play during this ordeal.
