Class Action Notice Sent Out For Lawsuit Against NCO Group, Credit Bureaus for Alleged FDCPA Violations

A class action notice has been sent out for a civil action lawsuit filed in the Eastern District Court of Pennsylvania against NCO Group Inc., NCO Finacial Systems Inc. as well as Experian, TransUnion and Equifax for alleged violations of the Fair Debt Collection Practices Act.

The class action notice is being sent out to all persons in the United States that have incurred a debt primarily for personal, family, or household purposes, which was previously owned or serviced by Commercial Financial Services and was reported by NCO to one or more credit reporting agencies at any time between October 10, 1999 to March 31, 2004.

According to a release issued today, the Plantiff Carolyn Thomas, bought action against NCO Financial Systems Inc. for violating the Federal Fair Debt Collection Practices Act. The Plantiff claims that NCO used false, deceptive and misleading information when reporting information to credit bureaus for the purpose of collecting debts by changing the actual charge-off date or date of last activity to a later date, or simply failing to report any date of last activity. The Plantiff has also alleged that NCO reported the debt in its own name, or in one or more fictitious names, and did not report the name of the original creditor, which caused confusion or misunderstanding as to the source of the debt and the connection of the debt with NCO.


By proceeding in this manner, the lawsuit alleges that NCO ensured the debt would continue to appear on her credit report, and the credit reports of class members, beyond the seven year period permitted by law.


The U.S. District Court for the Eastern District of Pennsylvania has granted preliminary approval of a settlement between the settlement class and NCO. The settlement provides $120,000 in monetary benefits for distribution to class members and provides for separate payment to the Plantiff for her damages. NCO has agreed to pay the administrative expenses of the settlement and the attorneys' fees and expenses in the amount of $85,000, separate and apart from the Settlement Fund available to the Class.
