My husband bought a car from New Deal Used Cars on September 2,2006. He put the whole amount on his credit card.
They informed him that the car was from out of state and would need to be emissioned before it could get registered and that this was his responsibility. My husband went the following Friday to the emission test and faxed the information to the dealer.
The temp plate given to the car expired on October 16. On October 2 we called to make sure everything was correct and that the registration was on its way. The receptionist would only take our name, number and type of car. We were told someone would call back by end of day after they looked into it. No one ever called. We called again a week later and was given the same speech about a call back. We refused to hang up until someone spoke to us. Someone claiming to be the title manager came on the line and tried to say they didn't the emissions information. We refaxed it to them with a confirmation that they recieved it.
On the 16th we still didn't have a title or plate for the car. We called three times before finally the title manager answered. We were then told that they had run into a problem because the person they got the car from didn't sign the title and it had to be mailed back to them for a signature. we were told this would only take a few days and then they would send it to DMV.
It is now November 1st and we still don't have the title or license plate. All they keep saying now is that they are going to overnight it to us.
They sold us a car they didn't have a title to. Does this mean that they didn't own the car. So now they have our $8000 and here we are 2 months later without a title or plate.

This only adds to the disgust I have for car dealers as a whole. But aside from that, call your bank and have the charges reversed. There is a time window and I am sure you nearing the end of it. SO DO IT NOW!! Then call the DMV and tell them what is going on. No, a car cannot be sold without a title. Since you paid for it in cash and in full they should have given you the title right then. This company sounds like they are packing their boxes and hitting the road. So the faster you act the better your chances of getting your $$$$ back. Keep us posted on what happens. Ciao!

Fortunately he used a credit card. He can just call the bank and tell them what happened and they should reverse the charge. Follow up in writing with the instructions on the back of the card statements. Time is almost up to do this however, the dealer knows that so they've been stringing you along.
Right after the bank agrees with you to charge it back, take the car back and leave it there. Try to get some proof that you did return it.
I thought in most states where smog checks are required, it is illegal for a dealer to sell a car unless it has passed the smog check. The cost of the test and any necessary repairs are the dealer's responsibility.
