I am a custodial parent and have been trying to collect support from an absent parent. He is about 16,000 dollars in arrears and I have not recieved any money from him since November 2002. I gave CSE his tag number since he is out of state. They are telling me they have an address on him but they haven't heard anything from the other state as to why he hasn't been served yet. They want me to believe that they have checked with Employment Security Commission and that he is unemployed. My child is the oldest of his three. He has two other mouths in his house to feed and I know he is employed somewhere. Every time I call they tell me they don't have any new info on my case. They say when there's another state involved, there's nothing else they can do. I am in the process of hiring a private investigator to see if he can help me. I don't think NC CSE tries hard enough. I think they brush some of the difficult cases under the rug. Whatever makes their day easier, I don't think they really care since these aren't their children.

I have given up on calling them because some of them are incompetent and some of them just don't care. So I am just going to keep doing what I've been doing and keep my head up, My husband and I have been doing fine putting clothes on her back, roof over her head, food in her mouth without any help from him. My husband wants me to let him get away without paying, but I say it's my daughter's money, she's entitled to it and damnit I am going to get it, if I have to spend some of our money to do it, why should absent parents not take care of the kids they aren't living with????

Been around the world and back.. support is permanent

If one Attorney, provable by the BAR records, can attest to child support being removed due to marriage, please respond. I have never heard of it.

My Mom collected it, even after she remarried a very wealthy man. My wife collects it from her ex. I have cousins paying it. All of their exes are remarried.

All of these cases are in different states(about 12 of them) and all continue to pay/collect no matter what. In fact, my wife's ex took her back to court trying to get out of paying, and ended up paying MORE!

As I said, Kid Rock collects child support from his ex. He makes millions, and she makes nothing. He even had her arrested for failure to pay. He has custody, she is worthless.

Any parent who fails to pay should be thrown in jail. Put them on a road gang until they decide they want to pay. My buddy here in Jax got locked up. He eventually got full custody of his kid, and his ex has trouble remembering to pay now. They won't lock her up though...she's a female.

Reduction or elimination is possible. All you have to do is petition the court. Child support payment amount in many states is based on need, and in others based on number of children, and others is a percentage of a persons income.

Don't think every other state is like the one you live in.

In some states a live in boyfriend can cause you to lose child support.

Move to NV if you want to lose your child support. A friend of mine got remarried and her husband was unemployed, but her ex husband petitioned the court and she lost her child support. The ex husband fought on the grounds that he would take custody of the kids if she didnt want to support them.

I have lived all over the country and have seen all kinds of crazy laws. I spent 10 years in the military so I was exposed to people with these problems all over.

Every situation is different. Keep an open mind.
And, never say never.

Child support doesn't get cut off due to marriage

Child support is for the support of the child. Alimony gets cut off due to remarriage. No state will remove support of a child, even if the custodial parent marries a millionaire. Kid Rock collects child support, and his ex-wife is a pauper.

Alimony (also called spousal support) has limitations on it that includes either a set number of years or getting remarried, however, child support doesn't change because of these circumstances. After all, it's still your child (vs spouse) and the government requires you to fulfill that obligation. Having additional children seldom changes the amount that you are required to pay either. Unless parental rights are terminated (as in the case of adoption), child support is one of the ONLY financial obligations that a) CANNOT be written off in a bankruptcy and b)you CAN go to jail for.

To the OP: As far as pursuing the non custodial parent in this case, it sounds like at this point it's only keeping the wound open and fresh. You make no mention of any type of involvement with your daughter. In several states (MI included), failure to pay child support combined with a lengthy absence of contact with the child is considered abandonment, and grounds for terminating parental rights for step parent adoption. Given the amount of arrearages, and contact, it may be in the best interest of your family to pursue this option and move on. Don't get me wrong, I totally feel that a parent should bear the responsibility for any child they helped bring into this world, however, sometimes it's in everyones best interest to move on. Have you talked to your husband as to WHY he wants you to discontinue your efforts at collection? Perhaps he is open to adopting your daughter, and in fact feels as if she's already his daughter, and prefers that the biological father were no longer in the picture?
