While my mother was in and out of the hospital, someone fraudently applied for an auto loan on my mother's cadillac. My mother died in 2017, and as the executor of her estate, found out that One Main had a lien against her car. I called them and made them aware that it couldn't have been my mother who borrowered the money, as she was in the hospital or rehabilition center.
They reserached and determined that the application was taken online, and that the person who scammed them, had someone pretend to be my mother when they went to collect the funds from the loan. They are aware of the identity theft, yet continue to have a lien on her auto. In my opinion, they are just as guilty as the person who pretended to be my mother.
SHAME ON YOU ONE MAIN FINANCIAL. YOU KNOW THAT YOU WERE SCAMMED, AND YET, STILL HAVE AN ILLEGAL LIEN AGAINST MY MOTHER'S AUTO.

You then stated "They are aware of the identity theft, yet continue to have a lien on her auto." So is there or is there not a lien? Are you saying you have your own paid for vehicle? You then said there was no vehicle. So how would a lien be on her car? You stated she is deceased; so is this on your credit score? Something isn't making sense. So someone took out a loan in her name, but now there is a vehicle lein attached? How was this discovered. Why would a lien be placed on a non existent vehicle, yet you claim this other car which sounds like you defaulted on. Again, police report which should have been done right away. Why the wait followed by "a report will be filed?" That takes maybe half an hour. You can also get an identity theft statement easily submitted. Did this place send you a random vehicle claiming it to be yours? Whose name is it registered in?

It appears you don't understand the circumstances here. Let me make it perfectly clear. IF One Main had a valid lien, they would have repossessed the auto, they know they don't which is why the car is still in my possession. Second, WHY would I return a car, that my Mother never borrowed money on? Your comment makes no sense whatsoever! It's not a matter of me wanting her car, or transferring the auto to me, it's a matter of wrong versus right.
A police report is being filed, and I expect the title will be returned to my mom's estate....where it belongs.

This can easily be resolved with a police report. Sadly, debt collectors are aware of the identity theft excuse to get out of payment responsibility. Often times the identity theft excuse is used once wages are garnished; or credit reports get marks. Since the car is in her name, a simple police report, death certificate, can expidite the matter.

Possible. You then state "They are aware of the identity theft, yet continue to have a lien on her auto." You said she was deceased so why would she need a vehicle. Make arrangements to return the car. It sounds like you thought you could get a car under her name, or transferred to your name. As stated prior, Police report. Simply claiming a responsibility is not mine is because of "identity theft" is not a legal defense. The real scammers are those who defealt or fail to make payments. And well..deceased, why would she need a credit score?. You get it?
