Last year I was contacted by a law firm stating that I owed money to Palisades Collection from an old ATT wireless account from 2002. To not make this long my records showed that I paid in full, plus the "law firm" was unable to verify the debt. After calling cingular, since they bought ATT, they said I had an outstanding debt, but again they couldn't tell me for what or when. Palisades also took the liberty to put it on my credit report, very nice of them isn't it.

So I had my university provided lawyer mail them a letter to provided proof of the debt. They responded saying that within 90 days I would receive it. They never sent it. Now 7 months later Plaza Associates is trying to collect on the same debt on behalf of Palisades Collection and ATT. I haven't checked by credit report yet.

Once again a letter was sent out to ask for proof of debt. Is this to much to ask?

I have a good feeling in 7-8 months I will get another notice and since I don't want to go through a 3rd round I am strongly considering legal action. Has anyone taken this route? Any advice?

Here are a few step to possible help you:

1.request proof of debt, the last few statments on the account. Be pateint because getting the proof can take time, but in the mean time the account should be in a distupt status.

2. Find out when the company reported it as a disputed account, then wait 90 days to check your credit report (credit agentcies have 90 day to make the changes, and usually it is about that long, you can call the credit agencies yourself to report an account as a dispute.

3. Make sure that you have sent them a dispute letter stating why exactly you are disputeing it. Within 30 days of the dispute letter you need to sent your proof. Letter of payoff final statement with zero balance etc.

4. Collection agencies don't have control over other companies so if they are given bad information you can't hold them liable, they can't make credit agencies make new reports faster.

5. Protect youself. Keep final statments and any other proof of not owing an account at least 7 years. So that you can easily provided it to any company. Remember Identy Theft is very wide spread and is a long process to overcome.
