I received a phone call Monday before work from a law firm from Atlanta. The call came up as unknown, but with the number listed. When I answered, they asked if I was so-and-so, which I did confirm my name. The man then told me he was Shawn (sp?) McCullough, calling about a Heilig Meyers account. I do not have a Heilig Meyers account; they went bankrupt in the summer of 2000. He called out the last four digits of my social; yes, it was correct. I told him it wasn't though, and said he needed to do some checking.

Well, after searching the net, I found a John C. McCullough and Payne listed with the phone number I was called from. They are corporate lawyers in Atlanta; I wrote down the information. I also called the number back, and asked them to return my call as I needed some documentation for a identity theft report.

It took them two days to get back to me, and when the gentleman called THIS time, the number showed up belonging to a C. Alexander. Strange. He told me the address I had was invalid as they had 'moved to a new location'. Strange again. I asked for the specific store I supposedly bought from; he did not have it. He did not have the sales contract either, nor a list of what was bought. There was also no proof of ID. All he had was that the account was opened September 26, 2000, and charged off on September 30, 2002. Hmm. The stores are gone, went out of business in March accoding to what I found out.

Then he gave me the kicker: Palisades Collections LLC is who has the account. He informed me that he would call them to get additional information for my police report, and asked that I send him a copy of the report, a copy of what I send to the credit bureau, and a copy of what they send me back. He also informed me that he could not hold off forever. A threat, I'm assuming.

I have sent for all three credit agencies to send my report to me, and I have placed a fraud alert on my credit report. I have filed a police report, as well as found all the information I can on Palisades for the investigator I'll be talking to Monday.

If anyone has any other suggestions for me, please let me know, as I think I need some help with this.

I am on leave right now, so I have time to type this out...

Unfortunately, I will be back at work on Wednesday, so I will not be as available to help consumers fight these fraudsters.

I do, however, have a list of my personal favorite JDB's sitting on my report that I am currently evading... Once I return in 2009, I will start fighting them, they will violate, and I will end up settling in lieu of a Federal Court Case.

You see, these JDB's don't really want to see us in court. They want a default judgement. If you sue them, they settle quickly, usually for nearly the same amount you are suing them for. If they did not, they know they will lose... This would create Case Law for future suits.

Thats not right! You are like 14 hours ahead of me! I can't get my 2 cents in first anymore!

This is not a case of ID Theft- Palisades has illegally re-aged an old CC account in order for it to appear on your credit report

This is a case of a re-aged account! Palisades has illegally re-aged an old CC account in order for it to appear on your credit report. They are a Junk Debt Buyer, and need to find any way to leverage consumers into paying out of statute debts. This essentially amounts to extortion.

You need to send them a letter, Certified Mail, Return Receipt demanding validation of the debt persuant to the FDCPA (I have no knowledge of this account, and I am demanding validation of the above stated account. Prove to me that I am contreactually obligated to pay YOU this money, an accounting of the debt and all interest and fees, a signed contract for the account, and a copy of the purchase or assignment agreement giving you the authority to collect on the account). 5 days after confirming their receipt of the validation demand, dispute the accounts with the Consumper Reporting Agencies.

If they verify the credit report prior to validating the account, they have broken the law (Fair Credit Reporting Act, or FCRA).

Send them another letter in the same manner indicating that you are going to file suit in Federal Court for their violations of the FCRA and FDCPA.

They will not only fold, but may offer you a cash settlement to prevent the suit from going forward.

DON'T LET THEM TRY TO TELL YOU THAT YOU HAVE TO PROVE YOU DON'T OWE THEM! They are required to prove it by law. Stay off the phone, keep all communication in writing, and add a limited Cease and Desist order in the first letter... Every time they (or their agent) calls you after that is another violation, actionable in the amount of $1,000/ea to the consumer.

If need be, file suit. You WILL be paid for this.

For everyone else looking at this, this is EXACTLY the information collectors do not want you to know about. These agencies rely on consumer ignorance, and use threats and intimidation to convince you to pay them immediately, even if the debt cannot be proven to be yours or the Statute of Limitations bars enforcement.
