Petland Bought a 1300 dollar puppy and he died the next day. They admitted blame and willnot give my money back but want me to accept another puppy Springfield Missouri

I bought a german shepherd puppy on 23 June. Was unaware that the puppy recently had hernia surgery when we went to pick him up. On the evening of the 24th during a walk the puppy started choking and passed out. 10 minutes later he was dead. We brought out puppy back to the store the next day so they could do an autopsy and the results of the autopsy was that he had some kind of viral pnemonia which caused serious inflamation in his lungs. I orginally told the store manager that I want my money back and not a puppy but yesterday they decided that I could only get another puppy and not have my money back. I do not want another puppy from this place. I have all paperwork from the vet and the store saying they were at fault. I want to know the best way to get my money back.

here is the policy from their website:
We at Petland know that planning ahead for a new pet is essential. Still, sometimes circumstances beyond control hinder a customer's ability to fulfill the human-animal bond. Therefore, within 48 hours of a puppy's or kitten's purchase, Petland will gladly refund the customer's money less an administration fee.
not sure if this applies in your case, but its worth a shot.

What's the store policy on fraud?? Don't waste time with the manager. File suit in small claims court. You should have an easy win. There's no way this dog developed a serious viral infection in the 24 hours you owned him. If they had a competent vet check him out before purchase they would have caught it (if they wanted to). Failing to inform you of the hernia surgery simply added to the intentional fraud.
It sounds like they're in dire straights for cash. Don't delay..........

What is the store's policy on refunds? If they have a policy in place to not issue refunds, and its posted then you have little you can do.
