Portfolio Recovery Associates, LLC Was sued by them. Junk Debt, 11 years old, I won. Ripoff Norfolk Virginia

This company sued me for a 14,000 dollar debt they say I owed.

They could not show me any information. I demanded the information about the account, and not jsut their printout. I wanted the actual information.

Instead of responding with the information, and knowing I demanded the information, they made a written motion to court for the case to be passed indefinintely. They didn't even show up to court relying on the fact that I was unsophisticated and would just wait for the case to be reset at some time in future.

I was also contacted to make an easy payment plan.

Now doing some research, I know in my state, a debt over 6 years old cannot be collected on. The Statutes of Limitations are expired. And everywhere I looked said dont accept a payment plan unless the court orders it. Accepting a payment plan would restart the Statutes of Limitations.

So I showed up. They didnt. The judge was going to pass the court date. I made a plea to him that it wasnt fair that they wanted to pass on this because they didnt have the information to show me that this 11 year old debt is still in effect with the statute of limitations. That I knew nothing about any other court judgement (which in Tennessee has a 10 years s.o.l. after judgement and they should be here to defend the reason why they need additional time, esp since they swore to the court that they had the records.

I think this case should be dismissed and never to be brought up again."

He did just that. Dismissed with Prejudice.

Show up to court and make them defend the debt. According to a 2002 SEC filing that they did at sec.gov, they boast that usually they only have about ten or 12 data fields with no records, buy the debt at rate 25 cents to the 100 dollars or less, and dont mind to wait until that irresponisble youth, drug additct, divorcee or drunk finally gets their life together and then collect and pay their debt. Ususally a person wants to clear up their credit record.

Show up and argue the S.O.L. That is why the states and feds made it law.
