PrePaid Legal Services (PPL) has failed to honor my refund request of $135.80.

I became a member of PPL on 12/12/2005, pursuant to my membership agreement, I could cancel my membership and receive a full refund. On January 9, 2006, I contacted PPL (via telephone) and informed PPL that I was cancelling my membership immediately. PPL told me that I needed to confirm my cancellation in writing. Accordingly, on January 10, 2006, I wrote to PPL and put my cancellation request in writing.

PPL continued to charge me a monthly membership fee for the months of March, April, May and June, for a total of $135.80. Unfortunately, (since my wife does the bills) I was not aware of these charges on my checking account until July.

In July, 2006, I contacted PPL again and informed them that I had cancelled my membership in January and that I was overcharged. I told them I wanted a full refund of the $135.80. PPL stated that they had not recevied my written request in January and that was why they kept charging my checking account.

I told PPL that I sent my written request on January 10, 2006, and that I did not know why they did not receive it; I suggested three possible reasons: (1) the request was lost in the mail; (2) the request was lost in PPL's mail room or (3) the request was improperly processed by PPL. PPL still did not refund my money. I then contacted the Better Business Bureau (BBB) and lodged a complaint with them.

PPL responded to my BBB complaint and they acknowledged that they had received my January 9, 2006 cancellation request, but, they stated that they never received my written request of January 10, 2006. PPL informed the BBB that if I could "provide documentat that [Mr. Badanes] sent and our offices received of an [his January] cancellation, we will review the information and another determination will be made as to his eligibility for an ... refund."

It is unreasonable for PPL to expect me to provide documentation of PPL's office receipt of my written letter -- I can not provide documentation of something that is entirely out of my control. The fact remains that (1) PPL agrees that I cancelled my membership on January 9, 2006; and (2) I sent written confirmation of that cancellation on January 10, 2006.

It is unfortunate that PPL will not honor my request for a refund, especially considering that I am only asking for $135.80 and PPL has probably spent more time and money in denying my request that in honoring my refund request.

The membership application specifically states that to receive a refund you must notify them in writing that you wish for a refund. What anyone else who may find themself in a similar situation needs to do is use the postal service's signature and delivery confirmation that way you have proof that your letter was sent and received.

You certainly make a bold claim that you sent PPL a written request but I, nor likely anyone else reading this, knows you so can't back your character. Having worked administration for the Navy for six years I've met hundreds of people who said they've turned in paperwork only to find the documentation later at their house or personal work area. You say you can't provide documention for something out of your control, yet the situation was completely in your control. Nothing kept you from sending this request through registered mail (which would have provided a signed receipt upon delivery) a service such as UPS which could provide tracking information. I hate to break some grown up news on you, but when dealing with ANY service based business it's your responsibility to ensure you know all the procedures for cancelling the service and that those procedures are followed and documented. If they never received your letter they don't know if you sent it or not, nor are they required to take your word for it. While I can understand your frustration, I can't accept your personal distortion of the facts because of it.

The true facts are:

1. Prepaid Legal acknowledges that you a request via telephone to cancel your service.

2. Persuant to your membership agreement you are required to make the request in writing.

3. You are unable to show that such a written request was made.

Whether you receive your refund or not I hope you've learned a valuable business lesson.
