Race-Depot Total Fraud Site Took Money Never Shipped Products! Internet

Placed order on DEC 8, 2007. Order #4860. Total $104.93 charged instantly to credit card. Website did not say products were on backorder or sold out before order was placed. I logged back on the site a week later when products had not been recieved and noticed the order had not even been shipped.

I emailed company asking what the delay was and recieved the following email from them 12/16/07... [Due to the overwelming response to our current sale, we are very busy with Customer orders, new product coming in, and responding to your e-mails. With more than 300 e-mails per day at times, we are doing the best we can to answer all of your questions. We have more of the 2007 Dale Jr. Car of Tomorrow Budweiser 1/24's, Standard 1/24's, Elvis 1/24's, and Elvis Caps arriving soon if you are still waiting on an order from us. We apologize for the slight delay] Needless to say the products listed in that email were not the products I even ordered.

On 12/17/08 I recieved another email stating the following [We have pulled these two diecasts from the site as they are both sold out. We however have your numbers guaranteed in our numbers that are coming in so you are ok. We are sorry for the untimely delay as we were supposed to have all of our numbers in stock last week but they all didn't arrive yet. We'll get these out to you immediately once they arrive. We wish you and your family the very best this Holiday Season]

I have continued to email, call and leave messages, I tried to log in the website this morning and it gave me an error. Untimely delay is an understatement! No product for 3 months and I no longer recieve email replies from the company and never have recieved any phone calls. Any recommendation how to get refunded?
