Race-depot.com 11/2007 order PAID for and still not received 6/2008 Newport News VA Internet

I ordered a Dale Earnhardt JR. 1:24 Elvis car on October 27, 2007. I was charged on my Charge Card on October 29, 2008 for $78.94 shipped.

It is now June 27, 2008 and I still have not received my car. I have emailed race-depot.com at least 5 times since then. First my order was "over sold" and was on "backorder". Then they said "it was coming and I was not being patient enough". They told me that "they sold more than they had, but not to worry, there were more coming".

They actually responded to my first two emails, but have have totally ignored my last 3 emails. My account there shows that my is "pending". I have called their 1-877 phone number and just get an answering machine stating "they will call me back".... which they have never done.

I emailed them at the beginning of this week. Their customer service explanation on their web site states that responses of any kind will be done within 2-3 business days. Since their website allows for Cancelling an order and getting a full refund, that is what I requested in the last email.

Still no response, and none expected.
