I decided to seek other employment with a competior. I submitted my last commisions in the amount of $1500.00 . When I went to pick up my check on 8/27/04 there was a memo stating Pursuant to company policy, commissions is based onthe employee leaving in good standing status, the time frame for commissions paid is up to the sole discretion of management. Needless to say, employment with a competior precludes you from "good standing" status.

IN addition of not getting paid as discussed with you at your time of resignation, you are in position of company documents that must be returned at your earliest convenience. Failure to return these documents in a timely manner may have legal consequences. The only documents I have is copies of my sales .

As with most situations in life, there are two sides to every story--the "facts" are as follows:

Point one--commissioned salespeople are paid when the product sold has been paid in full and delivered to the end user. This is standard and customary pratice in the retail as well as wholesale marketplace. Simple logic should prevail--you do not get paid for simply writing an order and taking a deposit!

Unfortunately, the commissions requested were not valid sales--some had canceled, others were not paid in full or delivered prior to (Terry's)last day of work.

Point two--(Terry)deciding to seek employment with a competior is acceptable, however actually working for a competitor while still in my employ is unacceptable and unethical. Honesty and integrity (or the lack there of) are also a point of concern. I cannot imagine that this action would fall into anyone's view of being an employee in "good standing."
