Resale By Owners Resalesbuyowner - David Lanza Advertising Deceptive S. Daytona Florida

I found Resale buy Owners on the internet. I was looking to sell my 1 week vacation Time Share that I had purchased. I was called by David Lanza, who was very aggressive and pressured me into using their company to sell my time shares by using my debit card and that they would send me via e-mail the contract to sign and send back to them. Everything told to me by David Lanza, was nothing like the contract that was e-mailed to me, so I called him back and told him that I had changed my mind after reading some negative reports about the company. He said no problem, that the money would be put back into my bank account. I contacted my bank immediately and asked that they not let the funds go through, but they did anyway. After the funds were released I asked my bank Capital One to get involved to get the money back. I was told I had to wait 30 days before they would get involved in case the company did return the $399.00. I kept in contact with David and was always told the same thing, that the money was in transit between my bank and theirs. This continued, and has been an ongoing continuation which has now turned into almost a year. After waiting 30 days I contacted the bank again, as I have continued to do with no results. I filled with the BBB with no results, and the Manager at Capital One said he faxed my paper work to the fraud department, only they say they never got the paper work, and because time had now lapsed they could no longer do anything about it. Another problem which I am still trying to resolve since it was Capital One's fault my paper work was not received in time, since I was told I was not allowed to fax it myself, but that I had to go to my branch and have them fax it. I was informed the $399.00 would be put back into my account withing 7-10 days....still I have not been reimbursed by either Resales Buy Owners, or Capital One. I am a VICTIM on both ends.
