I have been getting calls from RPM apparently for some time at my parents house. I forgot to pay my last bill to Sprint PCS so they sent me to this company for collections. However the number they have been calling for me is at my parents house. My mom started complaining to me that I need to call them because they were getting 10-15 calls a week from them. So one day I was over there helping my dad with something and guess who called...RPM. The lady on the phone was real polite and help me set up 2 payments to take care of the charges.

Payment # 1 was authorized for November 3rd (AKA Payday) It was for $131.35. So november 1st rolled around and I went to look at my bank account online and it was negative. So I looked at it and RPM had taken money out of my account that was unathorized. So I called them and they said they would listen to the tape recordings and if it was indeed unauthorized they would refund me the money and also pay for my over draft fee. They said to call back in up to 2 days to find out the status. I called every day for 3 days and keept getting the same response. "we need to listen to the tape recordings."

Payment # 2 was authorized to come out on the 5th of december (payday). But guess what. The 6th of November came around and I look at my bank account again and RPM had taken the second payment unathorized out of my bank account again. 2 unathorized payments in less than a week. I called them because naturally I was very p.o.'d. So in talking to the gal who answered the phone they had listened to the tape recordings and I didnt mention dates for the checks to come out. Wrong answer. I did indeed do that. So we went back and forth and she said something to the effect of "i just listened to the tapes and you didnt and thats final." so I said...great can I get a copy of the tapes please? And she says...oh they are lost now. We cant prove that you said any dates now. So again, I was pissed off I asked to talk to the manager. she said that the tapes were lost as well and assured me that I didnt set up dates with the checks. Then eventually after much arguing and multiple phone calls after they were transfering me to their supervisors (which every time turned out to be a fax machine) they said well we might be able to refund the money. I said.....how long would that take...72 hours minimum. I asked the gal, is there a way to push that through faster, can you talk to your boss. She said and I quote..."I have kids to take care of, I'm not going to risk my job asking my boss a question like that." I couldnt even believe it. Now they insist that my records are lost but are going to refund me the money. But I'm not settling there. I want them to pay my $388 debt as well as my $20 over draft fee that they charged me.

Heres the deal. I contact the better business bureau as well as my state attorney general. I found out that in washington state collection agencys are not allowed to make more than 3 phone calls to you a week. Also in washington state it is the law that if they take money out of your account more than 5 days after you talk to them they have to give you written notice within ample time. RPM has broke the law here on both accounts. My dad thinks I need to contact a lawyer.

Marc,

I never once told anyone not to pay their debts. I challenge you to find one rebuttal that says that.

What I have said many times is to NEVER pay a third party debt collector. Big difference here. Most of these involve very old, charged off AND sold debts, mostly past SOL for collections. Paying them does not benefit the debtor in any way, nor does it benefit the original creditor who lost the money. The only one to benefit is and INVESTOR commonly known as a JUNK DEBT BUYER who bought the debt for pennies or less on the dollar.

This IS what I have stated. So, therefore, if there is no reason to pay these third party debt collectors/debt buyers, there would be no reason to speak with them as their only objective and only acceptable outcome of such conversation is to get a payment, right? Therefore there is no reason for conversation because no payment is going to be made.

Debt buyers are investors and are entitled to nothing.

Furthermore, bad debt in itself is a result of PREDATORY and IRRESPONSIBLE lending. If creditors would practice responsible lending, they would not have to worry about so much bad deb, right?

Responsibility goes both ways. And as far as higher costs for everyone, that is BS. If everyone paid there debts, we would still pay the same, as they would just find another reason to gouge us.

This is what big business does.

I see you all over the board telling people to not talk to collectors, don't pay their bills, etc. Do you ever hear of the outcome of any of these cases, good or bad? Do people actually heed your advice to not pay their debts? I'm not trying to start a fight with you, it's just that from reading your many posts it encourages deadbeats to continue to be deadbeats. These people have already made bad choices by skipping on paying debts, ripping off businesses, causing higher prices for the rest of us, don't you think you're doing harm in the long run?

Matthew,

Forget the BBB! They are absolutely powerless to do anything. They have no legal authority at all. They are not a government agency, they are a for profit business. Why would they penalize someone who is paying huge membership fees? The whole thing is a scam.

Do as I said. File criminal charges on them for taking funds from your account without your permission. This is a crime.

A lawyer will cost you at least $1000 including court costs which you will need up front.

Well I had talked to a gal last week named Jamie who agreed to give me a refund for the money they took out that was unathorized. She said it would take 72 hours. However, after 72 hours the money was still not there. I called in on friday and they said that the accounting people arent in on friday so i'd have to call Jamie again on sunday.

Sunday I called jamie and we went round and round till she talked to her boss and president of the company Bob Polus. She gave me his cell phone number. I called him about 10 times till he answered his phone.

Basically what it came down to is that he said since I complained to the BBB he decided to put my account on hold and that there is no way in hell he would refund my money. Then we got into an arguement and I gave up. I told him my lawyer would call him.

So any lawyers here want to take the case? I want this guy and his company to pay for what they did. My sister has a friend who is a lawyer with a lot of experience with collection agency's but I havent heard back with his contact info yet. They have $257 of my money and wont give it back.

Under FEDERAL LAW, the calls could have been stopped with a CEASE COMMUNICATION request sent by certified mail, return reciept requested.

Forget the BBB. They are absolutely powerless as they have no authority to do anything. They are a totally useless and corrupt organization.

Also file a complaint at FTC.gov, as the number of complaints brings enforcement.

You can also sue them for damages.

NEVER speak to ANY collector over the phone, and NEVER, NEVER, NEVER give them your banking information! This is ALWAYS a mistake, as you already found out.

File a dispute with your bank and just tell them that you never authorized these funds to be taken from your account. Then file a larceny charge against them too. I bet they find the tapes then.

After reading many many complaints on this site I think I have found the person or persons responsible for calling my cell phone and hanging up 20 times a day. After giving RPM my cell phone number I started getting numberous private name calls on my cell phone daily. Nobody else who has my cell phone number would do that. I dont understand. I guess I should have investigated this company before I decided to give them my information.
