I had an automobile accident where a truck was changing lanes entering my lane of traffic and hit the side of my car with the side of his truck.  The truck driver admitted to me that he did not see me so he thought the lane was clear.  We took pictures showing my skid marks starting in my lane of traffic thus showing that the truck had to enter my lane to start the impact onto my car.

The truck drive later changed his story and convinced one of his passengers (carrying this personal friend in his truck was against his company's rules) to say that I entered his lane to hit him.  There was also another woman driver that said the same thing - however, this woman gave me the finger when I passed her 2 blocks before the accident scene (I passed her because she was weaving back and forth over 2 lanes of traffic in an unsafe manner).  This woman was pissed off that I passed her and I suppose that this was her way of getting her anger vented.

The Insurance Company did the investigation and ruled me in fault saying that they chose to believe the truck drive, his passenger, and the woman that was pissed off at me for passing her.  They chose not to consider the FACTS that my skid marks were in my lane of traffic proving that the accident started in my lane of traffic, thus the truck had to enter my lane of traffic.  The auto repair shop also said that the only way the damage to my vehicle could have happened is by the truck laterally compressing against my car and that it would be impossible to create this type of damage if I had hit the truck.  The Insurance Company chose not to talk with the repair facility.

I absolutely did not cause this accident.  The pictures show this, and the repair said the same thing.  However because the Insurance Company classified me at fault, my insurance premiums are now 73% higher on all 5 cars in my Insurance Policy.  I cannot even go to another Insurance Company at this time because of the "At Fault Accident" label they have put on me.  I am really a victim here because I really know for sure that I was not at fault and have the pictures to show.

In the picture, the circular black mark on my car is from the truck's right rear tire grinding and compressing sideways against my car.  This occurred when he was trying to come from his left lane of traffic changing into the right lane of traffic, where I was and he could not see me.  I have other pictures including ones showing that my skid marks started in my lane of traffic and not his; thus he came to him me.

I got into an accident with a safeco driver who ran a stop sign.  I did get a police report and it also said driver failed to stop but being on a private road (parking lot) no one would be cited.  Safeco refused to pay 100% of my claim saying I was 20% at fault for improper lookout.  I had to go thru my insurance company to get my car fixed and I am out my deductable.  My insurance company says other driver 100% at fault and they r fighting on my behalf.

I'll bet the truck driver HAS to lie to protect his job. Big motivation there. When the driver told you it was his fault that constituted an 'excited utterance' which is admissable in court as an admission of guilt. It wil be up to a judge to evaluate the veracity of it. Legally, you can take the truck driver to small claims court for damages. If the police report backs you up you should have an easy case.

You did call the police, right?  What does that report say?  Also, flipping you the bird and lying to investigators seems rather odd if all you did is pass the other driver.  Why is passing so frowned upon?  From the pictures, I fail to see how you can tell who entered which lane, so I am not surprised the insurance company hasn't talked to the body shop.  I can also see why they would believe 2 separate witnesses and not you.
