I brought my car in May 2011 from Carmax and Santander USA financed me. I financed 18,960 and I put down $5000.00 in cash to lower my payments. I have always been on time making my payments on the 24th of every month. I fell behind last September of 2013 I had my car for 2 years at this point. I finanlly made the Sept and Oct payment together on Dec 23 two days before Christmas my truck was repossed. They took my truck at 3am Sunday morning when I called to see what I could do I was told to pay november and December which would have me current and the $400 repo fee would be put on the back end of my loan. I paid the $1020.00 at 1pm Sunday afternoon but because it was Sunday even though I could pay for it I could not pick my truck up until Monday morning. I picked my truck early Monday morning and I was told that the repo would not go on my credit because by Maryland state law if your vehicle is repo'ed and kept for 3 days or longer then it would go on your credit. Not only did they put it on my credit when I went to pay my truck off keep in mind the date I bought the truck and how much I got it for they said I still owe $18,960 as of 2/14/2014 and my trcuk's maturity date is 1/2018. Every payment I have made ALL went to interest from day one. Not one of my payments went to the principle. I get called 10 times a day for payments then I tried to do a tripp which is their form of lower your payment so you can pay it off but I was told that my interest is too high and the only way to help me is not to do a tripp.
They have been a total nightmare. I made three payments of $509.00 in February (2/7,2/20,2/28) and all post but the last on which posted on 3/14/2014 and now their saying I still owe Feb, March and April but Keep in mind I made 3 payments to pay in advance. Then the guy tells me that the payments where returned I did not know you culd get an NSF on a bank card or credit card I NEVER used a check because when I did use my checks they did not know where the payments went so now I use my bank card and I still have the same outcome. I don't know what to do but its stressing me out completely. On top of making my payments I have put over $3000.00 into the truck for repairs as well as cosmetic.. I'm at a total loss..

Michelle I know you want the last word so here some more food for thought. Santander had no right taken my car at any rate it does not matter if I put a period here or there. I'm sorry sweetheart you don't know how to read. Also let me say this you don't know everything that is going on. apparently I'm not the only one this is happening to, but since you have nothing else to do you can get that last donut and read everyone's complaint that's what lonely people like you do. As I stated before you do not know me so don't come for me because I did not send for you. My car was illegally taken now if you want me to tell you everything do another rebuttal which I'm sure your boring a*s is gonna do and attach your number and I'll give you a call. I think it's ashame how you don't know someone but you're trying to make it personal. Another food for thought since you're so for Santander guess what I'm not the one that has multiple lawsuits again me b****..

Punctuation

The misunderstanding was due to a lack of punctuation in your original post. You wrote: "I finanlly made the Sept and Oct payment together on Dec 23 two days before Christmas my truck was repossed." Had there been proper punctuation, it would have been clear.
However, you said in your original post that after the car was repossessed in December you were told that you had to pay November and December's payments in order to get your car back. That tells me that you were not caught up on your payments and that you were at least one month behind at the point of repossession. And with repossession comes a lot of fees, charges, and so forth. That's just how it works.
At any rate, it doesn't matter whether you were four months, two months, or even one day late - they have the legal right to repossess. It's their vehicle until it's paid in full. I'm sorry you've had to learn all this the hard way.

Don't come for me Michelle

Michelle if you had read carefully I said I made Sept. and Oct. payments together I went on to say on Dec 23rd my car was repossed. I never said I was four months behind. In my statment I did not say I made those payments in Dec. I made those payments in Sept. I NEVER said I made those payments in Dec. They illegally took my vehicle and may I add I was up to date. Now let me school you when you have a simple loan a portion is suppose to go to interest and the other goes to the principle. If all your payments go to interest and none to your principle you will be paying a car note forever... The only lesson I learned is that companies like Santander try to find legal ways to rape their customers and then their are assholes like you to back them up. You don't know me but you probably have read the other stories and all of us are saying the samething. It is not right for a company to this and think they can get away with it. I have made my payments and up to date but I'm not paying triple the cost on a vehical that is not worth not even half that.

Late Payments

By your own admission, in your original post, you were four months behind when you made two payments in December 2013. Those two payments left you still two months behind, which is (I'm sure) the reason for the repossession. In the early years of an auto loan, the payment do go toward the interest. That's not a ripoff if you agree to the terms (and when you sign a contract, you do agree to the terms of the contract). I hope that this is a learning experience. It's easy in times like this to assign blame to others, but in order to learn from our experiences we must see and admit and learn from our own role in the matter.

And The FACTS Are.....

You didn't pick these people to finance you...you were placed with them because of your reputation for not paying your bills (otherwise you'd be dealing with a bank with a much lower interest rate). They did a repo because (surprise, surprise) you are again not paying your bills on time. You stiff them for payments, they repo and now you expect them to work according to your schedule. Sorry, despite what you've been thinking, you aren't entitled to a car while not making payments. Any problems brought on due to the repo were caused completely by YOU. Since you obviously do not understand finance, here are the facts: At the start of a loan most of the payment goes toward interest. This is normal. Since you've been late apparently numerous times, you've generated extra interest for them as well as late fees. Finally, in a feeble attempt to put up a smoke screen you complain about the condition of the car. The bottom line to all this is unless YOU decide to handle your finances maturely, you're in for a life as a serial deadbeat who blames everyone else for problems YOU have created. Oh yes, don't waste one split second of effort claiming I must work for them, because I don't!
