i have a shall gas credit card that i havent used in several months. last month i noticed a balance on my card and a late fee. I assumed that i just forgot that i used my card and went ahead and made a payment paying my credit card in full. This month, i again checked my credi card statement and knowing for a fact i did not use my credit card I knew the recent charges were fraudulent. i double checked my statment fo the last few months and there were charges at a shell gas statio at two locations in Tamarac, Fl. When i called to dispute the charges the crdit card company continuously insinuated that i am at fault. I have both credit cards to my account and my wallet was never lost or stolen which tells me that there is a skimmer at the pump of these location and most likely a shell station emploee has stolen my credit card information. My credit card company refused to refund te payment i had made or remove the charges that remain on the card tis month. They said they will send an affidavit in the mail and that it will take 7-10 business days for me to receive it. Also, i was advised that it will take about 60 days to refund my money. I am being held responsible and have lost money sue to shell gas neglegence and i am the one who has to jump through hoops in hopes of getting my mney back in a few months. i canceled the credit card and would love to tae legal action.

As a "Card holder" you have several responsibilities.

The primary one for security is to keep your card with you at all times and IMMEDIATELY report any fraud issues when you discover them.  While you did keep your card with you, you did not report the fradulent activity.  In fact you actually paid the bill for the fraud.   This pretty much will kill any fraud claim you try to make later.

You say you just "thought" you used the card.  Okay why would you think that?  Do you have receipts showing you used it?  Do you remember going to the places that the card was used at on the days it was used? 

As for any other charges.  FEDERAL law gives you 60 days(or 2 billing cycles) to report fradulent activity.  If you fail to report it within 60 days even if you have undisputable proof beyond a shadow of a doubt that it is fraud, the credit card company can legally hold you responsible for it.

This is why just like a regular checking account that you keep track of ALL of your purchases and reconcile them at the end of the month when you get your statement.  Anything you do not reconginze you immediatly report.  It doesn't matter what credit card or bank you are with, this applies to EVERY single one.

As for filling out the affidavit, again this is STANDARD when you are reporting fraud.  Because believe it or not people report fake fraud in order to try and get out of payments.  So this again covers the credit card company as if you tried(not saying you did) to scam the CC company and they found out they would come after you criminally.

So sorry, but even if there is a RipOff here, your lack of attention and failure to report it things in a timely manner is your bigger problem.

As for the Gas Station, you would not only have to prove that they had "skimmers" on their pumps, but they knew about them and allowed their employees to steal your information.   There are many...many ways they can get your number, and it could have even been a card number they got many months before the shell station.  

Did you even file a police report?

So you have a Fraudulant charge on your credit card.

OOPS

Most Credit card fraud happens 30 to 90 days after the theft of your card information.

Because of that Pointing the finger at the location the transactions were made at is a bad Idea, If they decide to do so they can sue you.You are reporting fraud, the Idea that you will have to sign leagle documents should not be surprising, nor should the fact that the station who is going to be back charged for the transaction will have time to appeal SHOULD NOT COME AS A Suprise or be a source of complaint.

Think of it this way, you were ripped off, your Credit Card company is willing to give you the current charges back.

Be happy, the idea that you have a valid complaint is just silly.
