Hello everyone, I would like to share my experiences with Sundance vacations in an attempt to cancel my "contract" and just simply get my money back. So I sent Sundance a notice of cancellation and my rationale behind it which included not informing me of my right to rescission within 3 days which is required to be afforded to me under the Pennsylvania Unfair Trade Practices and Consumer Protection Law as well as their unlawful marketing tactics they are performing by violating their agreement filed on 5/20/10 with the New Jersey Attorney General's Office and New Jersey law by offering a cruise in return for sitting through a sales promotion. But yet they snub their nose at the law and continue their usual unethical tactics.

After a few days, I received a voice mail from a "Sandy", requesting I get in contact with her about my account. I called her back and advised her again that I would like to cancel my "contract" and receive a refund of my money. She said "we can't do that" and that there is still a balance on my account.

I told her they violated my right to rescission and provided material misrepresentation by not informing me of this right, to which she refuted by stating because I signed "in house" I waived my right which is completely untrue as that has to do with where I was contacted for the sale, not where I signed their agreement. Then she states they are not in violation of the agreement with the New Jersey AG's office because I was informed that I was required to pay taxes and port fees, which too is total nonsense.

If I'm not mistaken, it's clear as day "3.2 Sundance Vacations shall not notify any person by any means, as part of an advertising plan of scheme, that he or she won a prize and then require him or her to do any act, purchase any other item or submit to a sales promotion effort, in violation of N.J.S.A 56:8-2.3." Seems to be exactly what they did to me.

Then she tried to tell me how they have a good rating with the Better Business Bureau, which for one they aren’t even registered with the BBB, and second anyone can get a good rating by simply paying for it. I then advised her again that I just want to cancel and get my money back, to which she stated she can't do and we hung up. Then just yesterday I received an e-mail from a "Ronald Cool" to resolve my account, and that the message is a from a "debt collector." I filed an official grievance with the New Jersey Attorney General's Office, Division of Consumer Affairs, and hope to get this matter resolved quickly.

I called their "financial" company Tri-state Financial and told them that they will no longer be collecting any more money from me as I had a right to cancel. The individual on the other end said that I had a "loan" outstanding and needed to pay that off and that they don’t cancel accounts. I requested to see a copy of a canceled check or wire transfer to prove the existence of this mysterious loan, to which he told me they were unable to do so as it's not "standard business practice." I told him that he couldn't because one did not exist, which caused the individual to become slightly upset and raise his voice and tone. He ended the conversation by saying "collection calls will continue” and this will affect my credit which in itself is another load of nonsense since they are 1.) Not a certified lender, 2.) Not registered with the three credit reporting agencies, and 3.) Are trying to get me to pay money on a non-existent loan.

These people are liars, cheats and thieves and have a very dirty business with no regard to the law or consumer rights. Why they haven’t been shut down yet is beyond me.
