My friend has a loan through United Auto Credit and she is defaulted because her and her husband have experienced Financial Hardships in the past few weeks. At the time she took out this loan she did not know me. Recently I have been receiving phone calls from the United Auto Credit in Urbandale, IA asking for my friend. I have explained that I do not want them calling me at my workplace or cell phone numbers, however, they continue to do it. They call my friend like 3-4 times a day and leave rude messages. It is rude and un-necessary. She has explained she cannot have phone calls at work and they still continue to call her work number. What will it take to make these people stop!!!

How did they get my phone number to my cellular phone or especially my work phone number?! Can they access phone bills, etc? Help!

UACC HAS A DATA BASE FULL OF PERSONAL INFO...

UACC uses services such as Master Files and Accurant to get info on their debtors. They will also call your references everyday until they give up info about you. It doesn't matter if it is legal or ethical , collectors are told they MUST collect the money. We are instructed to tell debtors to borrow money or donate blood to get money. It is ridiculous.

On another note, UACC has a practice of paying men more money than women. They are in violation of the Equal Work for Equal Pay Act of 1963 along with discrimination of women over 40. I know an employee who found out a co-worker was making a great deal more money for equal job time. This employee whent to her branch manager who responded by saying he did not care but that he would contact the regional manager.

The employee was then told to contact HR. They told the employee they did not have anything to do with it and to contact district manager. The employee contact the regional manager who told then employee they were just trying to "stir up trouble" and that the pay was determined by what the employee made at their last job (?). The regional manager was going to contact district manager to "research" the issue, so far nothing. Has anyone else out there had it problem?

If enough people go after UACC with these obvious issues, the company will have no choice but to comply with the law or sink in court costs and settlements.

Chances are that your friend listed you as a reference on her loan, which to UACC means call you as many times as it takes to get you aggravated enough to do their work for them. It's UACC's policy of "uncomfortable collections" which in summary is stepping all over the gray line between legal and illegal collection techniques. Actually UACC should call references if and only if they have reason to believe you have more information on how to reach your friend since your previous contact. You might ask if this or calling your friend at a place of employment is legal when told to stop calling? The answer is that it is indeed illegal to do this, as is disclosing any personal information without the consent of you friend, which apparently is also common practice at UACC judging from the posts I am seeing and my personal experiences at the company as a former employee.

UACC will likely hold to the belief that the FDCPA does not apply to them as they are not a 3rd party collection company. I would hold to the belief that the courts would hold UACC to the spirit of the law, even if it could somehow be argued that the FDCPA does not apply directly, which it should.

Even so, you have privacy issues and harassment issues here, all of which I suggest you and your friend pursue accordingly.

If enough people go after UACC with these obvious issues, the company will have no choice but to comply with the law or sink in court costs and settlements. If you think this is bad...try working for them!

Your problem seems quite easy to me. Simply send a certified, return receipt requested letter to United Auto Credit and firmly tell them that they are not to call you anymore about this matter. Further, state that you have nothing financially to do with your friend's loan and them and inform them that you will consider any further contact from them to you as aggrevated harassment. If they are fool enough to contact you after that, then simply go down to your county DA office and file a criminal complaint for aggrevated harassment.

As to your friend. Your friend is gonna have to deal with them regarding their calls to her. I suggest you stay out of it - you're priority is to get them to stop harassing YOU! Your friend is gonna have to fight her own battles, although you might suggest to her that she read the FDCPA and FCRA to get an idea of what she can do.

Take care of your issue with them and stay out of her loan problem.
