Our home was financed thru Chase Mortgage in 2000. We were never more than a few days late in our monthly payments, until 2003 when we underwent a bankruptcy. Even then we never got more than 30 days behind. We made arrangements with Chase to defer one payment, thus enabling us to get back on schedule. I even started paying MORE than the minimum amount, hoping to get ahead.
HOWEVER, in Dec of 2004 Chase sold our account to Vanderbilt. I followed all the instructions in the notification letter I received, mailing my (on-time) Jan 2 payment to the Vanderbilt address given.
Vanderbilt did not post it to my account until the 10th or 11th! The check cleared MY bank on January 12. The next morning Vanderbilt attempted without authorization to DRAFT an additional payment from my bank account! Fortunately, there wasn't enough in the account to cover it.
After MANY phone calls, faxes, etc., they repaid me for the overdraft fee, but now they are constantly harassing me. They insist that I am a month behind.
I have repeatedly faxed my entire 2004 payment history to them, ck #'s, payment dates, etc., but they refuse to admit that my account is in good standing. I get harassing calls at work, at home, even leaving messages with my BOSS!
How do we take action? Isn't there a govenment agency of some kind that is supposed to protect us from these type of vultures?

I faxed my complaint and within 30 minutes each one of the above responded via email, they were awesome - my situation is a little different than yours because my mother resides in California, but any one and/or all of the above can and will help you or direct you to someone who can.
Also, take a lot at the Fair Debt Collection Practices Act - www.ftc.goc/os/statutes/fdcpa/fdcpact.htm
it outlines the abusive, deceptive and unfair debt collection practices that are illegal.
Good luck - don't let Vanderbilt Mortgage get away with taking unfair advantage through intimidation and threats.

The FDCPA ONLY applies to accounts that are in charge off status and the original creditor has placed them with a (or sold them to) a 3rd party collection agency.
The ruling the previous poster was looking for is RESPA. I'd contact your state's Finance Oversight Board (they usually are the department that licenses mortgage companies - the name varies in each state)
But if they are refusing to report your loan as current, then also notify your states Atty General's office and send dispute letters to all the credit reporting agencies.

I also have vanderbilt mortage, although we haven't had problems with them personally.Here is a good bit of advice if they are contacting you at work and they know your boss disapproves under the FDCPA (fair debt collection practice act) legally they cannot contact you at work anymore.You can sue them for that. If you go to www.ftc.gov/credit click on consumer rights you can read what constitute under that act.I hop your matter gets resolved.
