I have had my loan for over 11 years, and thank the good Lord never have been late on a house payment. This past June 07, I sent the payment on the 29th of May due the 15th of June. I monitor my checking account almost daily and i notice that after the 7th of June the check had not cleared, We called the company, they said, " "we dont have it". i kept monitoring the checking account, and no payment had been taken out of my checking. so i called again, " got the same story". on the 14th of June, I made arrangements to put an extra 500 $ in my bank to send them a E-check, so that my payment would not be late.. On the 15th I did the E-check.
It took till the 18th to clear, but theres was no late payment. Now i still have the other 500 $ in the bank for the check dated May 29th. to which they say " We dont have it". Low and behold on the 20th , IT CLEARS ! Just 2 days after the E-check.
What a rip off. Oh, by the way, they tell me on the phone " If we get the check, we will apply it to next months payment" Now I am out two house payments in a space of about 5 days. ( personally) they should have sent the check back, they had no legal right to cash it or to apply it anywhere without my permission and todays date is June 21, 2007. IM out a total of 512 $ this month.
Doesnt the law say that its their problem if the check was mailed and dated prior to the due date? Looks like " In my option " they conventionality healt the check and would not post it! My wife tells me thats against the law. Well wake up America, we are dealing with rip offers. All they want is money
What kind of company are we dealing with here people. Claims they don't have the check, want an E-check, applys check to account without permission, dont have proper information as to were the check was for 18 days.

The address you send your payment to is a lock box. That is at a bank that the company pays to process payments. Vanderbilt has contracts for many lock boxes in several states. Now on your coupon book it states it may take 7 to 10 business days to receive. There is no guarentee on postal services and delivery unless you send priority and certified.
Any time you mail a check you are taking the risk of lost mail or damaged and undeliverable mail or at worst case mail being intercepted by a person and god knows what they can do with your information. Check by phone and epay are free and they are electronic drafts to your bank. Vanderbilt never sees your check. A bank does. Now about them cashing the check you authorize a check when you sign it.
If you do not put a stop payment on it at your bank then it is still legal tender. There was nothing cashed without your permission because you sent the check and did not stop the payment. Again vanderbilt does not see it so they cannot pick your payment out of the thousands received daily. The processing center opens, scans the payment coupon then scans the check. They enter in the dollar amount of your payment then the bank processes it to your bank.
If your payment is not received and your rep tells you that you can make the payment by check by phone or epay and to stop payment then it is docuented on the account and understood why there is a stop when the check comes back and that is fine. These are things you need to consider when you mail a payment. hope this helps

They will probably continue to do this since we have no proof of when they actually received our payment. However, the postal service has been taking an incredibly long time getting mail to their destination too.
You should have stopped payment on the previous check, then paid by E-Check. Also sent a written letter as to why you stopped payment on the initial check stating you felt it may have been lost in the mail. I know, you now know that for next time. At least you don't have to make next month's payment, though I know it's tough making two payments in the same month. It's a good thing you weren't charged the late payment fee.

Often times a notary is not required for documentation, whether it be signing a title to a car or mortgage documents, depends on your area (state) etc. I am in a different state so not certain about your state. Always read documents, always, always, always. Desperation may make us more willing to do something we normally would not (pay higher rent etc) but it does not excuse us from taking responsibility for our actions. If you don't understand it, don't sign at that moment. Take documents and review them. It seems this site contains a lot of people who should take a more pro-active role in their own finances. Just, to let you know, I too learned this lesson the hard way, but it only took one time. I read everything now and will not be bulllied into signing anything I do not understand. Best of luck in the future.

I have a bad mark on my credit from this company. I was told that I was leasing the Mobile home but in fact I was purchasing it. Also the paper work I sign was not notorized at the time I sign them and I was told that, they didn't need to be there at the time of signing of the LEASE. Later after I moved in I hadn't got my paper work and when I asked for it I was told that I need to redo it because it was lost.
and Still after signing it again, no notory was there, but I did get the copies with not notory signature on them.
Very shady company and please spread the word to never trust this company nor to do business with them or any Clayton Homes dealers, they too will falusifiy your documents to benefit themselfs and you will pay for it with your credit. I just moved out and never looked back. I got a bill in the mail for what I owed to them after they said They sold the unit and it was the loss they had to take. But I just got a sum that they said I owed to them but did not enclosed the asking price of the unit, nor at what price it sold at.
So, YES THIS COMPANY IS A MAJOR SCAMMERS " Consumer please be aware, run from these companies. I wish you the best of luck in your dealing with them. But, I would move and sue there pants off of them. I wish I could have, but I am to poor to hire a big gun attorny. I lived in DENTON TX. And we have in the area about 25 different Clayton home parks and they attract the lower class people. And the unaware are the ones that pay the price, I was just to poor and newly divorced.
So that made it much easier for them to scam me and my child.
