We voluntarily surrendered our mobile home on 9-01-05 . after months of harrasment and vanderbilt threatning to come get our home, but enough of that i am over that now we just decided it was not worth it anymore. they raised our payment 130 dollars a month and we could not afford this and insurance payment.
We voluntarily surrendered home on 9-01-05 .i did evrything in writing and sent evrything certified mail. since then they have sued us and sent court papers but i forgot to mention we own the land it is sitting on.
Since 9-01-05 and it is now 11-01-05 they have still not moved the home they will not call me back and i just get a run around about how they will contact their mover
that has been 2 months ago that they said it would take a couple of weeks.
Does anyone know what my rights are to get them to move the trailer or anywhere i can find out,any help is appreciated.

I have the same problem they served me I let go
back. And it has been 7 years and now they are
tring to sue us but the statue is 6 years in
Tennessee so I am just wanting them to try to
sue me because I have a case waiting in court.

we received court papers that they were suing us but nothing was said about vacating the home we had already moved out a month and a half before we got the papers . i advise anyone not to do business with this company. i spoke to a lawyer he told me to send a certified letter stating we were charging rent on our land. i did this . we will see

We were served with court papers to vacate 9-15-05. We did voluntarily. We also own the land the mobile home sits on. Vanderbilt will private sale the home so they don't have to move it twice. In our state we have a civil case to have them move the home. They are basically "squatting" on the land. You can charge storage and damages for not being able to use your land. This all involves a court case against Vanderbilt. Fortunately the sale of our house is pending. It only took one and a half months. We will be able to be back on our land soon. So if you want them to move it before they sell it to someone you need to talk to an attorney. Good luck.

I am not sure of the type/size of your home but if it is moveable I would unhook it from all utility sources and hook it to a tractor and move it to a corner of the yard, set it on blocks and make sure to cancel any insurance you have on the home. Then I would bill Vanderbilt $3000.00 for moving it and $20.00 per day for storage. You should notify them in writing (certified of course) of your intentions. You should then be able to put some type of lein against their interest in the home. In my state if they were to leave it for 1 year it becomes abandonned. This may seem a bit drastic but it is definately what I would do. And besides they deserve anything bad that happens to them.
