I purchased a truck in Oct and have been trying to get a title from Wells Fargo Dealer services so that I can register (and drive the truck). After MONTHS of being on the phone with their title servicing department - sending MULTIPLE copies of the request via fax (they wouldn't just accept the phone call request), they finally sent a PHOTO COPY of the title - which, of course, the RMV laughed at.
I called the "office of the president" and spoke with yet another lady (they only give a first name, refusing to give any sort of ID to summons someone in to court) who now says it will take another 4 - 6 WEEKS.
In the meantime, I'm paying for a truck I cannot drive because I cannot register it. I need an atty who will sue on a contingency basis for loss of use.

Not sure who you are or what horse you have in this race - perhaps you just like to troll the internet and throw your opinion out to feel as if you have something to say.
I put exactly what happened in my report. Bought a truck. Wells Fargo Dealer Services financed it and is, therefore, the lien holder. They are supposed to issue a title (I'll break that down for you - when they finance a vehicle, they own the vehicle as the lienholder. They are supposed to send the appropriate paperwork to the DMV so a registration title can be sent to the borrower (me) so I can take that registration title to my RMV and get the vehicle registered in my name.)
Until I have that piece of paper, I cannot register the vehicle and therefore, cannot drive it. (That would be the loss of use part)
If you work for WFDS, get off your computer, walk over to the title department and take training with them.

First off Wells Fargo is a lender, they do NOT "issue" Titles. The only agency that issues titles is the State Agency in charge of titleing, generally the Department of Motor Vehicles or that State's equivalent. Now, they can "hold" a title if they are a lienholder, and as a lienholder they will not release the title until the lien(loan) is paid off.
The Motor Vehicle department needs the title as proof that the seller is releasing their claim to the vehicle. It also shows that there are no other liens on the vehicle. If a title has a lienholder the DMV will NOT transfer ownership without authorization from the lienholder listed as well. If you have a loan on this vehicle, the dealer you bought it from or the DMV should be able to help you with the forms you need to submit to register it. Oh and if this is not clear..you do NOT get the title to the car until you own the car "free and clear".
If you purchased this from a dealer, they should have provided you with the title. If they didn't provide you with the title they should be assisting you in getting it. If they do not, you may actually have a very nice lawsuit against them for selling you a vehicle that not only can't be registered, but they had no legal right to sell because they did not hold the title.
If you purchased this from another individual, if you purchased it without them providing you the title you basically just screwed yourself because if their is a lien on the car Well Fargo is under zero obligation to release the title to you just because you bought it. Your only recourse here would be to try and go after the individual who sold it to you.
Oh and even if the lien is released, they will send the title to the registred owner who had the lien. It would then be up to that person to turn the title over to you.
