About a month ago I noticed A fraudulent charge on my debit Visa card with Wells Fargo in the tune of $921.86 through Best buy. I called Wells Fargo right away after I noticed this charge & set up a claim through there claims assistance department. The representative helping me was very nice at the time, she said I would be receiving a provisional credit while Wells Fargo investigated the case. I was told I could file a police report if I wanted to, but it wasn't necessary since they would be handling it. I went ahead & filed a police report anyway to be on the safe side. I did receive the provisional credit the same day that I called which I was very surprised, I have been a customer for over 12 years with no claims to date.

Well here's were everything went south I received a letter in the mail early this week stating that the claim has been denied "We concluded that the charges were made by you or someone who had your authorization, the provisional credit of $921.86 has been reversed as the date of this letter." The Claims center was closed monday night when I called so I called first thing tuesday morning to try to sort things out. When I call and reach a claims specialist they tell me that the signature from the merchant matches the signature they have on file for me & that the physical card was swiped (mind you criminals can easily take a picture of your signature off a receipt from anywhere you sign a receipt as well as skim your card & make a duplicate or so Iv'e read from research on the web.) I had the center send me the signature in question, I'm also told because of this signature matching mine that the investigation is through - there is
nothing they can do at this time the credit will be coming out of my account. I get the receipt in question with the signature on it I then proceed to pull up my signatures from the past 2 years from checks I have written & none of them are even close to the one they say it matches on the fraud purchase.

I have called the center numerous times every rep telling me there is nothing they can do. I have asked to speak with a supervisor at this point, I am told they don't have them around I have to wait for a call back 12-48hr time frame well almost 3 days later no call back & nobody cares. I am being treated like a criminal, it seems like Wells Fargo only cares about there bottom line, not the costumer. I want to try to take this to court if possible, I am unemployed at the moment, me & the wife cannot afford this, we can't pay bills, mortgage etc...  My question is does anyone know the way of going about taking Wells Fargo to court, do we have a case? I have put together a PDF document with a list of my genuine signatures & the Fraudulent signature. I feel a Handwriting expert could without a doubt say that the signature in question is fraud. Please do yourself a favor and if your going to use your checking account Get a ATM only card. The banks want you to have the visa because they only get 7.5 cents per ATM transaction but with VISA Debit they get 2% of the purchase price, they don't want you to have a more secure card they want that money & when fraud happens on your card they don't have your back, Shame on Wells Fargo.

Get The Tape

Best Buy videotapes everything that goes on in the checkout lines. Have the police pull the tape and see who made the purchase. BB uses those cheesy signature systems that have the computer pen. Never matches with the handwritten signature. The big issue wil be if they really scanned the credit card. The video will show how the transcation was processed by the cashier. Was the cashier in on it??? let the police sort it out.

Were you at the store making a purchase just before this happened? Where were you that a criminal could take a picture of your signature? If you feel so strongly that this was a case of theft then you should follow up your initial police report to see what they have done to investigate?
